    Instructions for I-485J clearly mentions that its not needed for concurrently filed (I140 + I485) applications.
    AFAIK, It is used to tie you to a certain employer's I140, and to attest to the fact that you are going to join that particular employer after getting GC.

    My school marksheet does not have DOB ! Looks like I will need the affidavits.

    If the birth is registered with the concerned authority at the time of birth or around that time (not sure but may be with in a year) that should be fine. And if we get copies of those issues at that time or again in the recent time frames they should still work as the Birth certificate says the date of registration. If the birth itself is registered recently and the actual bright was quite earlier, then you would need affidavits.

    You can also submit affidavits by Parents for Non availability of BC, or missing or incomplete info like full name in the BC. Also you don't need an agency for the affidavits, you need that listed on a stamp paper and signed by parent and person issuing the stamp paper. In case of Non availability of BC, and they searched the Municipal office, village office or some one you can get a Non Availability certificate that they searched the records and did not find anything as it was not registered.

    I used affidavits from both parents and a maternal uncle who is above 18 at the time of my birth and a Non Availability Certificate from the Tehsil office.
    I also used affidavits for my spouse from both her parents, to just state that her full name was not listed in the BC even though it was registered and have one issued at the time of birth.

    You can get the affidavits now, ask parents to scan and send colored copies and attach those as evidence document.
    And then they can courier the originals and you should have them in time in case there is a interview scheduled.

    Hi Experts,

    I have question regarding my GC situation,

    My PD (June-2011) is current and filed for AOS. However I-140 need amendment (successor in interest) due to past acquisitions. Attorney says I-140 amendment can be changed to premium processing to speed up the GC process. I want to know if premium processing of I-140 help in getting GC faster ? Thanks

    I had a few issues with my birth certificate. It was in a native language and was registered 1 year after my birth. During 2015 fiasco, I obtained affidavits from both of my parents. The affidavit is on a notarized stamp paper. It can be executed by an advocate in India. I don't think you need any agency there. There are many certified translation services in US, in case you need that as well.

    Hi Experts,

    I have I-140 Premium processing related query. My PD is Jun-2011 (EB2) and have applied for AOS last month. However I-140 need amendment (Successor in interest). Attorney says I-140 amendment will around 12-18 months. So he is suggesting me to go for premium processing. Do you think going for I-140 premium processing help me in getting GC faster ? Also, can I change job if I get EAD first, while I-140 processing is pending ? Thanks

    On the flip side, is I485J needed for folks to justify a job offer when I-140 was approved previously in the past (say 3 years ago)? does it mean i do not need to provide i485j supplement since my FAD is current and underlying PERM, documentation prove job offer. You are right that 485 j is not needed when filing concurrently and confirmed by my lawyer (i have filed concurrently recently).

    Yes you need I-485J if you are not filing concurrently i.e. I-140 approved before filing I-485.
    FAD has nothing to do with I-485J. All that matters is whether your I-140 was approved before you could file I-485.
    You can use the I-485J to change employers if your I-485 petition has been pending for more than 180days provided your I-140 is approved.
    I had to file I-485J because my I-140 was approved in 2011. My colleague got his perm approved right in time to file I-485 in OCT2020 and did not need I-485J as he was filing I-140 and I-485 concurrently.

    My birth certificate only has my first name, and my father's and mother's first names that too with wrong spelling :-). USCIS accepted parents affidavits without any RFE so hoping your case will also be accepted.

    Underlying PERM will show the job offer at the time of filing PERM, how will USCIS know if the job offer is still valid?

    Remember, I-485 can be completely filed by only the employee with zero input from employer. 485J is the only form in the application packet that needs signature by employer. If you don't file 485j or I-140 with the 485, USCIS does not know if the job offer is still valid.

    This may be a net positive for you. Texas and Nebraska are black holes with no clear approvals coming out. NBC actually was moving at a rapid clip in September and processes faster.

    The bulletin specifies 140K as the limit. is CO not considering the spill over? Any thoughts on what these dates mean in the near future? Also appears like CO is retiring and these guys wont host these chats after 26th. It says only for consular questions?
