    Currently, what is the split noticed between EB2ROW and EB3ROW?

    You've asked what seems like a simple question, which ultimately does not have a simple answer IMO.

    At the simplest level, there appears to be continuing trend in ROW (no M and P) towards a higher % of EB3 PERM certifications. For Q1 FY2016 it seems to be about 50:50 and was nearer 60:40 in Q3/Q4 FY2015 in favor of EB2.

    However, not all cases require a PERM. NIW (EB2) and Schedule A (mostly EB3) do not require a PERM. Information is not available on the numbers of these cases.

    In addition, we are currently in a period of very high PERM Certifications. A lower % of EB2 cases does not necessarily mean historically less in number terms in the near future. The benefit is only likely to be seen when certifications return to more historical norms. This is only likely to happen when OFLC finish what appears to be backlog reduction exercise.

    Finally, current PERM certifications do not reflect current I-485 approvals. It seems to take about a year from PERM certification to I-485 approval, so we're looking at what is likely to happen in the future.

    The information required was not made available for the period likely to be affecting I-485 approvals now and for the rest of FY2016, so I can't speculate how the approval patterns might change.

    Are we sure that EB3ROW is higher than EB2ROW or even 50:50? Below is the link to CIS Ombudsman Report 2015. Please see Table 3.3 on Page 51.

    The table shows EB2 I-140 approvals vs. EB3 I-140 approvals. The table clearly shows a sharp decrease in EB3 filings overall from 2011 and increase in EB2 filings. Year 2014 does not look right for EB3, the number will probably be 4850 but ratio shifts dramatically high towards EB2. Maybe EB3 filings have overall decreased over the years which has ultimately resulted in EB3ROW being current now.

    Now we know that NIW and Schedule A do not need PERMs but they still need an I-140. Please let me know what you think about the above table.
