    Thanks much indiani for such an elaborate response. I got court summons for my spouse taking our 3 yr old out of seat belt . I didnt have to go to court but ended up paying the fine of $56. Indeed you are right , the word " clearance " has been causing me great anxiety and wild implications . My history has been spotless in terms of any clearance related checks , cant think of anything . Never had a single audit on taxes . Held important positions in fortune 500 organizations on H1B , got double masters in the US etc etc ..really cant think of anything . Even my name shouldnt evoke any additional screening .

    Not entirely true...and I use my own example...

    I had approached my congressman (Georgia) on August 8. On August 14 they mailed me a letter with a copy of the USCIS case status report printed right off the USCIS website.
    They probably figured since I was living in the boonies, I wouldn't be aware of the USCIS case status tracker !

    Blue states probably do a better job and have liaisons just for USCIS....just a thought...

    That's what I think too. These people must be using the word clearance interchangeably with final review and adjudication. I've seen a couple of people on Trackitt mention similar response.

    one possible translation is "review" as clearance could mean a lot of things not necessarily a security issue , at least that's my opinion.

    I completely understand how frustrating the wait is. But your case is not in undue delay too, there are earlier PD's than yours still pending. Think of it like its just 10 working days after you became current. Anxiety and stress is making you think all of this. As far as I've heard in this forum and few others, congressional queries dont help (just my inference), but no harm in trying.

    Its easier said than done, still I will say it, Try to relax and give it sometime. Just in case if you are worried about your traffic violation, I dont think your traffic violation is a big deal.

    I'm sure there is a lot of applicants with earlier PDs that are still waiting. But at the same time, there's probably more with later PDs that have had their GCs for more than a year. Also, It might be just 10 days since we became current. But the last time around, we were current for 6 months and nothing happened. Now, it looks like we will be current only for 2 months. And even if dates do not retrogress after 2 months, the available quota per month will be used up by porters. So, I really don't think anything is going to happen to our applications unless we take steps from our side. Even then, there is no guarantee that we'll be greened this year.

    EB2 - your traffic violation is quite minor. So I wouldn't be worried over that.

    However don't kid yourself with "clearance pending" = "approval pending". If it is "clearance pending" I would read it as such and ask USCIS or whoever what exactly is pending.

    Spend money on lawyer and ask that question to USCIS. I think it is unusual for a 485 to be "clearance pending" for 2 years. You may wait for 30 days since the date current because yes it is possible that the status may not have been updated in the system. But post 30 days - I personally wouldn't have waited.

    My last 2 cents for you and wish you the very best. It is said the night is the darkest just before dawn. You are experiencing the same. Lets hope it gets resolved in a week or two. But if not stay prepared to take next steps. Good luck!

    On August 15, 2013, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.


    During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

    Hi All,

    Today i received the CPO Email. I am thankful to Q, Spec , Teddy and other Gurus for all their help. You guys have been doing a wonderful job and i am sure people in future will benefit a lot from this site.

    Thank you MATT: Even though I hadn't posted a whole lot in this forum (or the other forums for that matter), I have always been following the data, analysis and calculations you folks (Q, Teddy, Spec and so on.. I like to call Q and co.) have been doing for years.. I wanted to take a moment and thank you all Gurus & Pandits in this forum for bringing as much light as possible to this inherently dark and mysterious process..     Q thanks for your feedback . I contacted my lawyer and was told simply to wait .

    I contacted senate office and sent them all the docs to seek clarification on " clearance " specifically why and what it is that is pending for 20 months.

    Upon reaching out to USCIS today , they say that they just have heavy workload and that sometimes background checks take too long . She did not confirm any specifics. Simply said " you have to wait until whatever time it takes "

    Next week I want to consider reaching out to senator's office as the staff at congressman's office believe that we need to give USCIS a month or so before we could contact again but I am afraid the visas may run out. At least I will be left with the satisfaction that I did everything that I could . I am in FL and will try to call both senator's offices and see who will be more responsive.

    I have previously posted the response from uscis to congressman's office which is a generic one. ( it mentioned that case is with an officer for review )

    Assuming 8K total approvals this month ( considering pace wont change) , about 12K ( 7.3K new demand in sept + 4K left over from august) total applicants will be current and approvable in sept.,

    I doubt uscis has capacity to process that many in 1 month.

    My estimation is 3-5K applicants will be left without GC even though they are current this fiscal year.

    That's upto 25% ( Not bad compared to last year)

    This is quite normal. It was obvious that CO moved the dates far beyond what the supply could meet. It will be the same next year too. I expect the dates to move somewhere between Jan 1 and Apr 1, 2009 (preliminary estimate) but there's no way we'll have enough SOFAD to get till there. I'd be surprised if we completely clear 2008.

    Last spring in 2012, did people "miss the boat" even after getting reply either by SR or other way (including congressional inquiry) that their case is assigned to an officer.
    I am trying to interpret the congressional inquiry reply as best I can, can I hope that there sure will be an adjudication since its "with an officer for review" or else are there any cases in the past where it has been assigned to officer but never adjudicated for various reasons?
    Yesterday and today the pace of approvals have slowed down dramatically.
    we have only 10 business days left in the month and after that there will be another 7.3K cases added and I am not sure whether the IO's will try to finish the cases already assigned or else will go for the "fresh fruits".

    Thanks for the detailed analysis, the last 2 days have been disappointing, hopefully the pace of approvals will increase like the week of 5th. even if we have another 4K approvals that should leave roughly 3K which might be considered for September.

    I really doubt there is SO of 20K rather by design few thousands might be left away for next fiscal year, while I think almost certainly dates will retrogress in October, I really hope that dates are left the same for 1-2 more months (in next fiscal year) as Q is predicting.
