Missing Birth Certificate

Good day to all.

Just have a quick question. If I do not have birth certificate, can the high school marksheet work? If not, what I should do?

Also in case of some unauthorized employment, at what time one should have to file 245K?

gtyagi - for missing birth certificate one needs to provide affidavits of parents and/or relatives. That's all. Check the forum for templates and more information.

Perhaps somebody else might know answer to 245.

245(k) is not a form to be filed.

It is a sub-section of the Immigration and Nationality Act which gives relief to some violations and Exempts Bars to Adjustment for Certain Employment-Based Adjustment of Status Applicants.

"An applicant invoking 245(k) is not required to submit additional application forms or payment of a penalty surcharge."

If you don't have a BC, then you need a NABC (Non-Availability of BC) from the local official (Municipality mostly). If you were born in the more administratively-painful part of the country, getting either is a pain. With NABC you need affidavits, and some secondary evidence - like Marksheets, School Leaving Cert. etc. There is whole thread on BC related issues - look it up.

As imdeng stated if you do not have a birth certificate you need a non-availability document from the municipality. Along with that you will need to provide the affidavits.
