    Lightbulb Birth Certificate Related

    my birth certificate has a birth date as Oct 5th 1978 but my actual birth date is Oct 8th 1978, Even my Passport and all my other certificates shows date as Oct 8th 1978. Can some one help me what steps should i take to get the birth date corrected . I was born in india.

    Ravi,

    If you are losing sleep over it tehn go to a lawyer (personal or company one). But personally if I were in your position, I would simply trust common sense will prevail. They will go by your passport date. Worst case they will issue an RFE.

    p.s. - Believe it or not, I have stamped my H1 without all the required documentation. The american burecracy is much more flexible ... as long as you have a credible case that you were born someday :-)

    Birth Certificate Related Issues..

    gurus...one off topic question... my birth certificate has my last name as a letter ... for example if my full name is Soggadu Shoban babu... my birth certificate has it as S.Shoban Babu... please let me know if this is a problem....

    I am no Guru... but my 2 cents - If you cannot get the birth certificate changed, I think affidavits from your parents with full name would help. I have sample affidavits if you need them. Just PM me.

    I agree affidavit is another option but i just want to confirm that i need to go that route...anyone has any experience here?

    My daughters birth certificate has the same problem. Both mine and my wife's name is shortened. When I talked to my attorney, he told an affidavit would do.

    I had the same issue. But i fixed it. Here they are more concerned with last name. Submit both the affidavit from your parents and also BC or else fix your last name in your BC.

    My wife don't even have birth certificate and can't get one while applying 485. So we used her aunt and uncle affidavits. you can get that in India on stamp paper and sign with them.

    Affidavit is good but if you have time, let your parents get in touch with the municipal authorities or the hospital where you were born.

    My Wife and I had the same issue but I was pleasantly surprised to know that municipal authorities have records of everyone born in a hospital. We were born in different cities but our parents got records quite easily.

    I would prefer having the official Birth Certificate from Government authorities, if at all it is possible. Good luck.

    Last name issues on Birth certificate

    all,

    I am opening a new topic here instead of EB2 thread..

    So this is my problem...

    Last name on Birth Certificate is just a letter. Soggadu Sobhan Babu becomes S.Shoban Babu

    Most of you are advising for affidivits... My father is no more and i have my mother and other relatives in india. Can you please let me know the process for getting these affidavits?

    Sorry to hear about your father. Regarding birth certificate, your Mother can go to the Municipal Corporation office and request them to check records. They usually ask for few days but with some pleading, etc., they might oblige for a quicker check.

    If they absolutely cannot find a copy of your Birth record, the 2nd step would be to go the Hospital / Clinic where you were born. They must be having your birth record. Get a copy of that record, take it to the Municipal Corporation and get a fresh BC.

    If neither options mentioned above work OR if you were born in a home rather than a Hospital, etc., your Mother has to work on an Affidavit but it has to be notarized by a Gazetted Officer. USCIS website has instructions regarding this alternative.

    TB, unfortunately the place where i was born in is very far from where my parents live now and i cant ask my mom to visit there... dont even have any relatives at that place now... Looks like only available option is to have the affidavit... what do you guys think??

    Just FYI (and please don't treat this as any ad); I used https://www.yourmaninindia.com/ during 2007 for retrieving my birth certificate from the city corporation and was quite satisfied with their service. They charged somewhere in the range of $100 - $150 (don't remember the actual amount) and got the birth certificate within a month. There was a error in spelling my last name and my father's maiden name and they even rectified those through the city corporation, though I had to pay something extra (another ~$30 - $40 or so). Overall, I paid in the range of $150 - $175 but I had no other option as it wasn't possible for my elderly parents to go to the city corporation office and pursue this issue. Even then, there is no guarantee that one can get the proper documents in time but the quality of service surely varies from city to city (e.g., I have heard from relatives that things are very streamlined in Mumbai).

    Place of birth mismatch in passport and birth certificate

    I got "place of birth" mismatch in passport and birth certificate, will this create a problem in my 485 filling, if it's a problem please let me know how this could be resolved.

    When I applied my passport i did not have the birth certificate so i had mentioned the place where i stayed since childhood .Now my parents could get back my birth certificate and the place doesn't match with the one given in the Passport .So will it be a problem when I file my I-485 and if it's a problem please let me know how this could be resolved.

    I am facing the same issue. Place of Birth in birth certificate doesn't match with that in passport.
    You can go to Indian Consulate in US for Birth Certificate. They will verify the place of birth in passport and will issue a new Birth Certificate.

    1) Get your place of birth corrected in your passport
    2) Try birth affidavits instead of Birth Certificate

    As Spec mentioned, I think its a very reasonable question. I can pitch in with some details from my pending I485 (PD 11th July'07). I have incomplete medical records (couldn't finish all the required medical checks before the 16th Aug'07 deadline) and there is a spelling error in my birth certificate. I haven't received any RFE on these yet and I assume USCIS will issue RFEs if/when my PD gets current. However, my case has been active meaning I have finished 3 fingerprints (with the last once being Oct'10), have forwarded AC21 docs to USCIS and have also received a confirmation saying that the AC21 docs have been appended to my I 485 application, etc. I asked my lawyer and she mentioned that USCIS probably has all the required documents in place (they would have issued RFEs on EVL, paystubs, etc if they had concerns) and might issue the medical and Birth certificate RFEs when my case gets current. But, I don't know exactly what's the status of my case, though I will assume that it is not pre-adjudicated since there are missing documents. On a slightly different note, I think USCIS can issue RFEs even on pre-adjudicated cases, right? I mean, even if a case is pre-adjudicated one might need to answer to probable RFEs before getting I485 approval.

    I am trying to get a Non Availability of Birth Certificate (NABC) & Birth Certificate (Late Registration) for I485,

    As per my Passport my name is Sundar (Given Name) Vadivelu (SurName)...

    in SSN \ marriage certificate name is "Sundar Vadivelu" and 10th \ 12 & other educational certificate Name is "Sundar", so i am not sure how my name should be in NABC & Birth Certificate... just "Sundar" or "Sundar Vadivelu"... please advice
