    AOS - adoption cases

    Guys,

    I dont know anyone personally who has filed AOS for an adopted child. In our case, it is my real niece, who we adopted about 1 year after my brother and sister-in-law passed away when she was an infant. We had no issues getting her H4 done, and she has been with us in the US since she was 5 and half years old. At the time of H4 and in the AOS application, we provided the adoption deed and her passport that lists us as the parents.

    Is our AOS application going to go for additonal review? Does anybody know of people who've been in the same situation?

    ontheedge, if at all there may be questions around why you had to adopt. But my sense is this should sail through pretty easy especially since she already is on H4 which is a dual intent visa.

    Thanks Q. We've also not been expecting any issues since it is an 'in-family' adoption and the H4 was granted pretty easily. As far as the possibility of reasons being asked..there is no right or wrong answer....I guess USCIS would just be making sure that there are no red flags. There was no question of not adopting her...she never knew her biological parents..and grandparents can only take so much responsibility. She is our daughter in every way and at this age, she doesnt know anything about her adoption.

    ontheedge, in-family adoption from immigration perspective are actually a problem - to my knowledge. However the circumstances here are so different (having both parents no more) that I am confident that USCIS will see the right perspective.

    For all its flaws - American systems actually work far better than many other places in the world - which is why the county is so prosperous - of the people / by the people / for the people. Right? Relatively ... but still .... it works.

    My best wishes to you, your family and your daughter!! I am sure she has a great future with you as her parents.
