My attorney didn't ask so we didn't submit. I am getting kind of anxious now after reading Nishant's post.

I have a question. If EAD/AP combo card has finger prints on it, can we assume that person's all checks related to FBI are done?

Probably not. But I think you can at the very least hope that you don't get RFE for fingerprints that were not clear. I've seen cases where applicants received RFEs asking them to get their fingerprints taken again. Some relevant info could be obtained here.

For BC this is what my attorney told and I found on uscis form instructions

(1 ) Child name should be full , FirstName MiddleFullName LastName
    (2) Both parents name should be full.
    (3) Birth date and date of registration should not be far apart , date of registration should be before child turned 18 years. Sooner is better.

If you have all these there will not be query on BC. my lawyer mentioned that some of his clients were not able to get BC in this format when filling window was short and they submitted as it is few got RFE , few did not , He asked me same when we were submitting ours. This way if affidavit needed and parents are not in USA and if you think it will take a while you can get it done once filled I 485 and be ready for RFE if ever arise.

    Background check for EAD?

Since my EAD and AP apps still say Initial Review with the text : Background check etc happens at this stage..

I am wondering what exactly happens since my Finger Prints are not yet avble for them to process.

Bottom line, is there any BC for EAD/765 thus shortening the time for actual I 485 process? Example a Name check is independent of FP right?

I just mentioned all dependents and marked as not filing and didn't attach my kids birth certificate. I think this is not of any concern.
Also worst case, RFE comes in and send the copies of birth certificate and will be cleared in 2 to 3 weeks.
Simple RFEs are not a problem and not a concern also. To me it doesn't matter if I get GC 2 to 3 weeks later so do not be obnoxious about RFE unless its a complex one.

You don't need it for US Citizen. If sone got RFE may be because they have one kid born in India and other here and officer overlooked country of birth.

As far as I can tell, there is no background-checks done for issuing EAD/AP. NSC applicants have been getting EAD/AP approved even without fingerprinting. I think the time between applying for EAD/AP and the actually issuance of one is mainly administrative overhead. Having said that, TSC applicants will get their fingerprints printed on the EAD/AP. So, they'll need to get their finger-printing done before their process could continue. So, that'll delay their EAD/AP issuance when compared to their NSC counterparts.

Well guys, all I can say is follow ur lawyers advice like family doctor. I will say that I am extremely proud of my attorney, he is very astute, responds in minutes to sensible email, and is ready to back me up till I am done with GC. He is expensive but smart to get all bases covered.

Trust ur lawyers, leap of faith.

US born child BC, I am guessing provides evidence of domestic bonding and close ties to USA
I am not a lawyer, and it's always best to consult an immigration attorney.

Both my dots are US Citizens and I was never asked to produce a BC for both of them while filing apps. Like Nishant says it may enforce the mind of the VO that they have roots but it may not necessarily determine an adjudication or not w.r.t 485

Curious..Any BC happens for H1 B extension etc? Like Name Check, National Security etc? Pretty sure it happens at the Port of Entry when they scan your FP and a hit turns up. But thats like a few seconds to report a hit

Yes, I agree with u completely.

Another thing, if asked to prove bonafide marriage, child BC is useful. Mostly such RFE is only for recently married folks, in which case anyways a child may not be present.

I was asked by my attorney to submit a copy of our US born child BC, but he clarified that it was more of a secondary evidence to prove bonafied marriage (other than MC) because it has both parents names on it.

I actually think they might do on case by case basis. One of my coworkers is from Kashmir, and he was stuck for 3 months. He noticed that officer scribbled 'visas donkey' on his paperwork.

You can read about this and other checks on

    some ramblings/musings( if you will)
On the same token, Retrograde mars and Retrograde Saturn aren't helping either...so, I'd expect them to process slightly better by end of April, when Mars turns straight and much faster in July when exalted Saturn turns direct

    LOL
