    Post G-28

It depends on what you fill in G-28. By the time you are at this stage, you are outside company's policies. It's your application from this point on. Most attorney's prefer their address as it makes their life easier.

I need input from you guys before I proceed,

JAN 2012 filer, hv receipts in hand. EB-2 India with 140 approved in 2009, with same sponsor employer from 5 years, full time position.

Attorney did not seek EVL, said W-2 and Paystub is fine. my employer can give EVL easily. after some research realised that EVL is an important initial evidence, So, I am wondering if I can send an EVL now to add to my application with a cover letter saying that it has been left out inadvertantly. Any risks associated with this or better to wait for RFE if any, I am just trying to avoid the RFE route if possible as it will add more months for an approval.
    any input is appreciated, thanks,

If its not a huge expense, I'd maintain my current address and do mail forwarding to your new address or have someone pick up your mail. I imagine Dec 2007 filers should get their GCs soon.

USCIS mails do not get forwarded to new address. I suggest you to change your address at USCIS.

One of my friends attorney said the same as yours and he had no problem with his GC.
The reasoning I came to know was since the latest W2 and PayStub is of the same employer as I140, it was not required.

    Gurus could throw some light.

we filed 3 weeks before you, got our EAD/AP approval and FP notice last week. According to the USCIS Level 2 officer I spoke to NSC FP notices are backed up.

You can expect to get those in next 2 weeks if everything else on the file is good.

For sure atleast by the Feb bulletin they have crossed the line by double even if one believes in demand destruction. By most estimates the intakes till 01-JAN-2010 would range between 35-40K. It’s a clear case of low demand interpreted as qualified or documentarily qualified is being used to advance the VB's. It’s good for all our friends waiting to file their 485's I sincerely hope this party continues but this could come crumbling down like a pack of cards anytime based on numbers. Also I wonder based on the link you posted earlier EB5 consumption is almost matching the cap thus far and EB1 is moving really fast on Trackitt, so our only hope this year is EB2 ROW which is the only category moving slower as of now.

    Processing Times updated on 1/25/2012

    Processing times updated.

    I485 NSC: 4 months

    I485 TSC: March 24th, 2011

For I-140, TSC says October 2, 2007, seems almost unbelievable. For I-140, NSC says 4 months.

    Check it out.

UPDATE: kd2008 has pointed it out above already it seems.

I am not a lawyer, and it's always best to consult an immigration attorney.

My attorney did not ask for EVL. Filed with W2 of 2010 and pay stubs.

    Hmm, that's very bad.

    Even I-131 & I-765 are Mar 24, 2011 for TSC applicants. :-(

I feel that before DOS stalls VB, USCIS is stalling its processing looking at the incoming inventory....

From trackitt, no one form India or China have received any approvals this week. Only ROW cases approvals in past 2 days. They might have approved all cases filed in OCT (which is highly unlikely). Or... visas have been exhausted (I hope this is not the case). Just my two cents. I am no expert by any means.

EB-I485, TSC was at March 29th, 2011 in November 2011 processing times update, now it went back to March 24th, 2011

    Nishant,

    For I-140, TSC says July 04, 2011 not October 2, 2007,

    Q/Teddy/Nishanth/Veni,

What's a good time frame to contact the senator/congressman about pending 485 app? Does, 111 days sound reasonable for TSC?

    Best!

The processing times were just updated NSC is 4 months and TSC is still in Mar 2011 so effectively we cannot follow up since we are in processing times. belmontboy reported his approval on ** he is a Nov filer.

    Teddy,

Are you saying that for TSC people who filed their 485 app in Mar 2011 are getting their EAD/AP now?

  22. #1197
Thanks! processing times for TSC are definitely unreasonable. Trying to see if anyone ventured to congressmen around 4 months time.

This is for GC, so if ones case is filed after that date we cannot call them for status. Several cases after this date have been approved though.

  24. #1199
Processing times for 485, not EAD/AP. TSC is bound to give you EAD/Ap within 90 days, if not you can raise SR.

Aisehi dimaakh mein 2 keeda aaya..

    1. Does it make any difference if one gets EAD/AP cards before FP or if you get them after FP (EAD card with your finger prints on it)?
    2. Assuming one gets a 1 yr EAD card.. is the validity 1 yr from RD or 1 yr from I-765 approval (Notice Date)?
