    Lightbulb Timing of I485 filing related issues

    Guys..I have a question. My PD is Feb 6th, 2008. I haven't done my Medical and Photo. I thought will look at VB and then schedule the medical, would that be too late...I know its valid for 1 year. Would you guys advise me to have everything ready expecting VB to go till Mar 1, 2008

    No, it would not be late at all. Even if the VB comes out on 11th, you'll still have about 19 days to get medicals done. It takes only 3 days to get back the records, duly signed. That is, if you don't have any of the diseases for which you are being tested . Even if you do, these three days are not going to help you cure before December 1st. ( Please take the later part in lighter vein)

    There's no wait time at the walk-in clinics, you go in, get poked for skin testing and blood work. Revisit in 2 days to get checked for skin-test and blood-reports. If you are good, they'll give you the sealed envelope which you must pass on to your attorney(sealed).

    dont hurry up, its not a big deal to get done later. this is not july 2007 fiasco where 100k+ people rushing to get medicals done in country.

    even with 11/8/2007 I am taking it easy and just waiting for actual current.
    I am not a lawyer, and it's always best to consult an immigration attorney.

    I am assuming your reason for not doing medical right now is - if in case dates don't move forward for a year, you would have to spend money again for your Medical when your pd is current. If it is not a big amount for you, just go ahead and do the medical (one less thing to worry about).
    and if you don't want to risk your money, i would just call the approved doctors in your area and ask them how long will it take to get the appointment, how busy he is.
    There is a risk in doing that, because if the flood gates open in next VB. the doctor may get so many people calling him and few of them may not get any appointment if he/she is overbooked.
    I dont' know where you are from. But where i live there won't be too many applicants even if d EB2 is current in next VB and so i can get appointment in just cpl of days of notice.
    so first think i would do is just call one of approved doctor in your area. There is no cost in calling a doctor.

    with PD of dec 31, 2007, I'm getting ready for application. I have scheduled my appointment on nov 9th. one year is more than enough time to get my PD current.
    dont want to delay the process if I get my date in Dec VB, especially with thanksgicing holidays and my business travels.

    Gurus,

    Should the applicant and the spouse be in the country to file for 485 or can the lawyers do it for us? I am going on a business trip and wife going to India. If this restriction is not there when does the fingerprinting happen? Hope to hear from you.

    You and your spouse have to be in US for I485 AOS.. fingerprinting normally happens in around 30 days if not too much of rush..

    Absolutely YES!, You and your spouse must be in USA to file for 485.

    Every Alien will have their own number. Aliens don't share numbers So, you enter your number on your application. If your dependent don't have one, they leave it blank. it's perfectly alright. Many people will not have A# even after 140 approval, so they leave the field blank as well.

    Congratulations to all who are current!

    I am current too and have a couple of questions. My lawyer is usually slow to respond and cannot be contacted directly too. So, can any one please provide some inputs?

    I am planning to go on my vacation, to India, from Dec-5th to Jan-4th. If I file on Dec-1st,

    1. Within how many days will I get my notice for finger printing notice?

    2. Will it come to my home address? In that case, since I will not be here, is it possible for it to be sent to the lawyer's office so that they can email me the information?

    3. Will it be possible to postpone my finger printing to after I return (in early Jan)? If not, what is the safe period before when I should return (in Dec)?

    4. If all of this would not really work, is it wise to file in January, after my return, than in December?

    I am not sure about is there is guaranted timeline when FP notice comes, but 485 does get denied if you don't show up for FP. and not filing in December is hara-kiri, do not, do not miss the opportunity.

    Personally friend, if possible, just don't go until you get EAD/AP in hand. This is my advice to anyone else, just stay put and get this done with, don't create complications.

    Do yourself a favor and cancel your trip. its very tricky especially with the holidays.
