    Question about H1 extension for 7th yr

    My 6th yr of H1 will be over in May 2012...My employer has applied PERM in sep'11...Can I still apply for H1 extension for a yr that my labor is still pending?

    But as per what you mentioned you cant apply to H1b extension based on pending Perm

    As The rule is that your PERM will have to be pending for more than a year at the time of your H-1 expiration. but as your perm is applied in sep 2011,
    it is not one year from the time you applied.

    I think you need approved perm to apply for H1b extension more than 6thyear( as you didnt apply for your perm by may 2011). better consult any good immigration lawyer of there are any unknown loopholes to this law...
