    Folks,

    As many of us are into Post I-485 filing stage, thought it would be helpful to everyone if we could share any I-485 RFE's. This way we can better prepare/plan ahead of time.

    I think Yes, those are the 2 types. Atleast that's what I've noticed on trackitt posts.

    I am guessing additional would be around birth certificate and initial would be around medical certificate like flu vaccines etc.... None the less, let's hope for the best!!!!!

    Initial V/S Additional Evidence

    Refer to the following instructions for I485 - http://www.uscis.gov/files/form/i-485instr.pdf. On Page 3 there is a section called initial evidence, I believe that this should correspond to the initial evidence RFE while everything else should be additional evidence.

    mrgreen I have edited the first post to create a list and details for all of us who received RFE's. I hope you are fine with that, tackel thanks for taking the lead. Maybe we can all share the following details SR NO - Handle - Type - Date - Details - Details RD - Response Date - USCIS RFE RD - Decision Date, I will keep updating the header with the same. I don't know but looks like NSC is mostly additional evidence while TSC is initial evidence. The dates are current till 31st Mar so lets now try to expedite the RFE stuff ASAP. Nishant had posted details a few days back that when a case has an RFE as soon as the response is received it goes to the top of the officers work queue, so now our focus should just be to send the response sooner.

    I just hope it has nothing to do with the employer/I-140. I'm beginning to think that it has to do with the TB test. My doctor mentioned that I will go through the 9 month treatment in the 693 form, even though I don't have TB. And I did not take the pills prescribed because of other treatments. Have to talk with the doctor and see what my options are.

    This waiting is very painful.

    I believe, additional is better than initial evidence It means that your initial evidence is good. Initial evidence folks can't say the same about additional evidence

    I received the response. it's the Birth Certificate for me. Looks like, someone in the mail room @USCIS had misplaced/reordered the birth certificates in bulk.

    my attorney is asking $250.00 to file RFE response.

    @Leo congrats in advance its probably a simple one. If you have a certificate issued from the time of your birth you can just submit the response on your own. You should see approval soon. I updated the header with your details as leo07 (TSC) - Initial Evidence - 02/09/2012 - Birth Cerificate - 02/13/2012.

    Since you must have a copy of the BC, it is a simple response for you. Just a cover letter and a copy of BC. If you feel like, you can file it yourself. Although considering the amount of money you have already spent (filing fee, civil surgeon, attorney etc) - and additional 250 is not much.

    Still contemplating

    Thanks for your response guys.

    I'm contemplating if I need to go with my attorney or not. Basically attorneys are suggesting to file bc along with an affidavit from my mother.

    The instructions in RFE are straightforward fwiw. The only caveat with my bc is that the officer who signed/seal did not put the signed date along with the signature and seal. birth date and the date it was registered are clearly listed though. RFE did not mention this but my attorney scrutinized it and wanted to be doubly careful.

    Leo if your birth certificate was issued within a year of birth then that in itself is sufficient, they have clearly misplaced it. If that is not the case then most attorneys insist on affidavits, mine in fact insisted on 2 from individuals other than parents. Both me and my wife had bith certificates with registration done within a year, mine unfortunately has the information about me all in English but headings in Hindi while for my wife everything is perfect except that it does not have her name on it because her birth was registered on the day of her birth. With all this Iam a little confident that my RFE is not BC related in the inetrim we got revised BC's for both me and my wife recently just in case.

    Registered after 1 month from birth

    Certificate is in English. Its registered 33 days after birth day. Do you have a sample of affidavit?

    I'll send that along with my bc. If my attorney is busy as she usually is, I'll send it my self tomorrow.

    Leo - it does make sense to put an affidavit or two in there. It is an easy document to get in India and provides supporting evidence. The best and simplest Affidavit format was posted by Q in the BC thread - my lawyer looked at it and confirmed that it is well written. Wait - I found a copy:

    Affidavit of Birth by PARENT

    I, ____________________, hereby depose and say:
    1. My full and complete address is ________________________________.
    2. That I, ____________________, was born on DATE in the town/village of ___________________.
    3. I got married on ____________ in the town/village of ________________ to ______________.
    4. My wife, ________________ was born on _____________ in the town/village of _________________.
    5. ________________ is our son/daughter, was born to us on ______________ at _____________ in ____________.
    6. This affidavit is being submitted because the official record of birth was not registered at the time of birth of ___________.

    I declare under penalty of perjury, that the foregoing is a true and correct statement.

    Leo, my friend got the same RFE (additional evidence). The RFE notice simply states that they need the Birth Certificates. But now, the lawyers are asking him if he could get the BCs updated with the full names (self & parents names). They did tell him that if it is not possible to get them updated, they can prepare affidavits.

    Can you please tell me if your BCs had full names on them?

    If USCIS is asking for BCs with full names, won't they specifically mention that in their RFE notice?

    Leo I used a simplified version of the following formats http://www.immihelp.com/birth-certif...ertficate.html.
    For Self - Grandmother & Uncle
    For Wife - Uncle & Aunt
    Both my parents and In-laws stayed as a joint family when both me and my wife were born
    My lawyer said affidavits have to be from someone other than parents. I your case I feel, that they somehow misplaced your BC, if the birth was registered within a year and the contents are fine there should not have been any issue at all. Make sure that the notary puts in a stamp saying internationally valid.
