Very good progress, looks like you have a good attorney. It took mine couple of emails and reminders after the details were received.

This is more about luck than numbers. TSC is still approving cases left and right one of my colleagues late Nov filer got approved today. Yes more numbers from Mar will help. What time did you get the RFE Response Received notification, I have not received anything yet and lawyer sent a notification Friday afternoon that response was dispatched. Iam wondering if TSC runs this notification batch process at some specific time of the day. My attorney Iam sure would not spend any money sending by priority mail so Iam hoping atleast my response would have been received by today.

I got the RFE Response Received notification around 5:30 PM on the same day it reached CIS. My attorney filed on 02/15 and I got the notification on 2/16. I think attorney did overnight as promised.

Many thanks. I got a mail from my attorney Friday afternoon that the response has been submitted and no online updates yet. Iam pretty sure they would not send by overnight or express mail but atleast today it should have reached by even priority or for that matter first class mail. Just waiting for that notification that USCIS received the response. Will wait for a day or two and then call USCIS.

Thanks my friend. In my case the attorney is a company attorney and they treat the company as the client. It takes several emails and phone calls for simple things. I will contact them and after that based on what they say will contact USCIS. Got some responses on Trackitt where some people commented that in some cases it might take 2-3 days for the status to change to RFE Response received after the actual receipt thanks to the large number of RFE’s now.

As soon as you file 485, you are the end client for your attorney and not the company. Along with 485 papers, you'll sign papers to retain him as attorney. company is no where in picture, and they don't even have to know about your gc any more. You can push as hard as you can.

Thanks Leo you are completely correct for I485 Iam the client technically as Iam the one who signed the G28. When the RFE came for EVL they said that they have to contact the company again even though they have the previous EVL and everything will go after informing the company etc, my HR manager is quite cooperative so no issues, he did issue a new letter which should have gone initially itself but did not go due to the attorneys insistence. I did contact the law firm to inquire about the RFE delivery but no responses, these people are plain unprofessional and unconcerned to say the least they will take their own time because no extra fee for RFE response. Looks like all loyalty is just about the money and since it is all company paid no wonder it’s completely with them. Normally I try to restrict to one call and one mail a day, only we can feel what we are going through quite frankly.

Yeah, completely understand the pain. These law firms are nothing but blood sucking leeches.

My latest theory is that some officers assigned to adjudicate 485 cases might only working on 485 cases part time and the rest of the time are working on something else!! Only this can explain why it takes them so much time to respond to RFE cases, since RFE cases are supposed to go to the front of the line for that particular officer when they come in, no? Either that or they have hundreds of RFE cases...

Hi 99mutd08, I got the email early on Thurs, Feb 23 and got it in the mail on Mon, 27. So, 4 postal days, counting Thurs. My lawyer got it the next day, i.e., 5 postal days. I've seen 1 week+ also on the forums. If you received the email late on Monday, chances are high that you will see it in the mail tomorrow or day after.

I called up the USCIS 1800# a short while back and told them about the case status issue on my case that it did not update to response review. The guy was nice he first parroted the current status and said that he cannot discuss my wife's case since she was not around as Iam at work. I asked him if anyone could check and confirm if the response was indeed received and it’s just an upload issue, he said that it may take upto 15 days for them just to upload at times or for a status update. He told me not to hesitate to call on Mar 10th when it would be 15 days. Within 15 minutes my case status changed to RFE Response Review. For me even this baby step is a step forward, I feel that this definitely has something to do with the call.

Thanks for update. Did you speak with second level or the first?
    Good Luck!

Finally!!...that's good.. now the next question is once the case is in Response Review, how long do you have to wait before you can find out what the status is?

He was a level one guy call was never transferred but sounded very helpful. Iam glad unlike my lawyer USCIS picks up calls and they are courteous, it maybe that this call logging event pushed something to my case status update or simply that my response was received only today and then uploaded to the system, my lawyer may have sent it by first class mail or this guy internally escalated beacuse I got the alerts within 15 minutes.

I would say that my clock really starts today it should be 3 days to 2 weeks now. Our good friend Leo has probably crossed 2 weeks.

Teddy, what I meant to ask is there an official wait period before you can call and find out about the case status? Ya, looks like Leo just crossed 2 weeks today, I think....

No there is no official period of wait. Theoretically it’s just another case for them so the standard 9 months backlogged TSC wait time applies. Nishant had posted some days back on the forum that once the RFE response is received the case moves back to its original position in the officers work queue. So we can just hope for the best now. Basically getting an RFE means 20-30 days of being pushed back and missing the chance on the day it was issued because it could have been the approval date.

RFE response review has a upper limit of 60 days. I spoke with a rep, same news reader response.
