Lightbulb RFE Discussion (All Kinds of RFEs)

Also, does anyone know whether MSC approves EAD and AP, or field office does it?

JoinedToAsk - EAD/AP and 485 application is processed separately. I see people are getting EAD after their PD become current and also getting 485 approval after few days of EAD approval. So there is NO standard processing pattern all is random basis. If you are lucky you should expect your green card within 1-3 months of your 485 application is actively touched (485J notice or issuing RFE).

Received RFE for medicals for dependent ; no update on the primary application
I am thinking I should send primary medicals for infertiling .
The address for RFE is a FIeld office. Shall i send the primary medicals to the same address with the cover letter ?
What?s are the thoughts on this ?

You should, as soon as possible. Don't overthink. Field office's adjudication is faster than service center's.

Thank you ! So to be clear you are of the opinion that I should send the RFE response ( for the dependent) and the interfile request ( for primary) at the same. field office address.

Shall I send them in the same package then?

    Thank you

Yes, include both medicals in the same package.

USCIS is sending out RFEs pre-emptively for medicals en-masse. They sent out a few thousand yesterday per Chinese Telegram group that scrapes data and anecdotes from Indian Telegram groups. For anyone who hasn't interfiled yet, I would wait to get the RFE.

I received the update on my case that RFS is sent on 1485 but does not talk about Medical at all. I hope it is for Medical only as I did not submit it earlier and received the text also. Is there a way to conform before you actually get the RFS paper?

I hope it is Medical RFE. Many received a text message on Friday (7/30) afternoon saying "..... who receive a request for Form I-693 should return it as soon as possible by overnight, priority or courier delivery." On Friday night online status was updated to "Initial RFE sent". Looks like for the folks whose I-140 is approved, Bio is done and PD is current received the RFE.

I have the reverse situation, inspired_p. I received the magical SMS and my status changed Friday evening but not for my spouse. Coincidentally I had already sent the medicals to attorneys on Thu that got delivered on Friday. I asked them to hold onto medicals until RFE arrives to see what it is and to get the correct addresses assuming it's for I-693.

If the RFE is for I-693 and if my spouse doesn't get an RFE by the time my RFE is received, I am planning to ask them to include my spouse's I-693 as interfiling request along with my RFE response. Fingers crossed that both files are in the same location/with the same AO. That is all I can think of. If anyone has any other suggestions, that would be great.

Right now the approvals are all over and random. There are folks from 2009, 2010 who files in 2012 still waiting.
Also a lot of people from 2010 PDs filed first time in Oct/20 also are waiting and have seems some approvals with PDs from May to Dec 2010 and also some in 2011 for all straight forward cases.
So everything is luck of the application being picked up.

sstest - I am in a similar situation, my case status has been updated showing RFIE sent but nothing for my spouse and son. I am hoping that an actual letter will come for all of us. I sent an email to the attorney for advice, will keep you posted. Please let me know what you hear from your attorney.

Got Medical RFEs for both(primary and dependent). Should I include primary & dependent civil surgeon sealed envelopes with a cover letter in single mail or post separately?

There is no need for a cover letter. You just need the sealed medicals and a copy of the RFE letter. If you plan to send it in a single mail, the advice I saw from many was to put each applicant's sealed medicals & copy of RFE letter into individual envelopes and then put these envelopes into the mail envelope and send it out. In my case, I sent them out in separate mail envelopes as me and my wife got separate RFE letters. The choice is yours.

Did you get any update on the dependent applications? What did lawyers say about interfiling medicals?

If anyone is in a similar situation, please help.

Here is what I have received - The RFE letter has asked to send the "ORIGINAL" letter back with the requested evidence and asked to ".... send the response TO THIS ADDRESS" and there is no address mentioned after that sentence. I am interpreting that I need to send the response back to the address mentioned on the top right corner of the letter on page 1. Does anyone think otherwise?

The letter is from SRC and the top right corner has Irving, TX address.

Also, today I received the letters for my spouse and son, not mine, even though their online status was updated on 8/2 whereas mine was updated on 7/30. Not sure why mine is still not there.

It did not get to interfiling discussion with lawyers as my spouse's status got updated as part of 08/03 RFE bulk update. The physical letter got delivered today.

I will touch base with attorneys on Monday to see when can they ship the responses.

I was curious though about the prevailing thoughts on what comes next after RFE responses for these bulk updates given that these RFE letters, at least for us, came from NSC. Will the application move to FO after this or is this year special where they will issues GCs directly from NSC.(My lawyer was saying that she has never seen applications in similar downgrade cases getting adjudicated without going to field office)

I have not experienced anything like that but I will take a stab at answering while we wait for more knowledgeable folks.

"Not sure why mine is still not there"
-- 07/30 RFE for me was delivered on 08/02. My spouse's RFE updated online on 0803 got delivered today, 08/07. Probably best to check with USPS, may be they can look. Also, RFE status has a link to e-request the RFE letter after 14 days. Probably next best option is to use that ifn nothing pans out on the USPS side.
-- Another option to consider will be to interfile your I-693 with your dependents for now while you work on duplicate RFE after 14 day. They only want I-693 probably given your status update was part of Friday bulk push.

"back to the address mentioned on the top right corner of the letter on page 1"
-- My RFE came from LIN and the address on the return envelope provided by USCIS has the same address on it as the top right corner office address on the first page.

In trackit I am reading and also in my company, lot of folks having the same issue. They received the dependent's RFE letter but not primary's. Maybe it's on the way. Yes, I can request an e-copy on or after 8/14; I think that's a better option than interfiling.

For my dependents' RFE letter, it says "send the response back in the enclosed envelope" but there is no envelope enclosed. From your update what I infer is, I can safely send to the address mentioned on the top right corner.

It is now close to 3 months since I have submitted my RFE response. I had opened an SR around July 20th by calling USCIS. I called them up today regarding the status of the SR and it appears they have closed the SR stating an officer is working on the petition.
