    Maybe I should have worded my sentence better. When I said unused numbers from EB3 can go to EB2 I was not trying to skip the process or hiearchial structure of spill over. I was looking at the bigger picture and the reason why the numbers might not be used for EB3 inspite of my FAD being current - inability for USCIS to schedule my personal interview this fiscal year. The same case will also apply to EB1 and every one else in the chain except our friends in EB2 India who had filed 485 before 2012 and do not require an interview. Hope this adds some clarity to my thought.

    Which is your FO. Mine got status changed to "Ready for Schedule " for Newark FO.
    I am EB3-i and my PD will not be current for next 3 months

    That is indeed great news, when did you file your I-140/I-485 concurrently? Also, when was your FingerPrinting done? Can the interview be scheduled without the FAD being current?

    Newark would at least a month to get the interview scheduled. Currently EB3 is at June 22nd. If we get the expected three months movement for EB3 you would be current for June bulletin.

    Congrats. That is good news your interview is being scheduled which is a definite progress and milestone.
    If your dates get current in the next couple of months, you should be all set.
    My FO is Lawrence, Massachusetts. I am in EB3 and filed my AOS in Dec 2018.
    My initial calulations were based on my colleague's case who had filed for AOS under EB1 in April 2017 had his interview in Dec 2018 at Lawrence, MA field office.
    He is still waiting for his date to be current.
    I'll keep this group updated if there is any movement in my case.

    Yes I know for sure interviews are being scheduled even when FAD is not current, based on the 485 filing date and time slot availability in respective field offices.

    Thank you for the quick response. My priority date is Dec 2009 in EB3I, and I filed my application in Dec 2018. Hoping for the best!

    Thanks. So any hopes of limited spillover for EB2-I is gone. CO conveniently does not tell anything about EB3-I, so it will likely keep moving ahead.

    Hello Gurus, long time dormant user. May be a dumb question and please move it to appropriate thread.
    Q: Can i move to Employer B with a totally different title (Engineering Manager) where my I-140 is approved from employer A with Senior Developer title and re-use the I-140?

    My PD is 2011 April and was for Senior software engineer and wants to take Engineering Manager with another employer who is willing to sponsor. Please let me know.

    Below comment and unsaid things about EB3I are the only positive thing in the monthly check-in with charlie. Especially since Philippines is one of the country using more unused EB3 worldwide numbers. Hope EB3I moves to Dec 2009 at least by end of FY 2019....of course more movement is always better.

    Since Eb2 won't get any spillover Looks like I'm finally ready to switch to EB3 (My PD EB2-I May 22,2009). I was on the fence last 2 weeks but I'm definitely doing it next week. This is just BS.

    A noob question:

    My India EB2 PD is in 2013. I am in the process of submitting EB1A/B I140.

    1) If it gets approved, and I file I485 soon (with an effective PD of 2013), how long could it be before I get GC ? In lesser than a year ?

    2) Does the I485 filing date supersede the earlier 2013 PD, and hence delay the GC for 2-3 years ?
