My PD is Dec- 29- 2009 - EB2 , Filed for I-485 and EAD in 2012 when it became current then it retrogated . Approved EAD and I-485 Pending. I am currently H1B (NOT Using EAD) .
-Any chances of priority date to be current in 2019?
-Can I downgrade to EB3 or should I stay , welcome your suggestions.

Now EB3India FAD is crossed EB2India FAD for the first time. That's a good news.
We can safely predict the USCIS will honor the EB3india FD next month too.
Also, we can expect the EB3India will move to 2011 in this FY itself.
Looks like still there is huge resistance to EB2India downgrading.
current since 10/01/2018, but still no approval. contacted congressmen, opened SR.. same old standard reply.. all the while I thought I just want to be current... now I know the pain of waiting after being current.

The above final action date projections for the Family and Employment categories indicate what is likely to happen on a monthly basis through May. The determination of the actual monthly final action dates is subject to fluctuations in applicant demand and a number of other variables. It is also important to remember that by no means has every applicant with a priority date earlier than a prevailing final action date been processed for final visa action, with applicants often processing at their own initiative and convenience.
Out of curiosity, How come Philippines (also south Korea) allowed to use more than their quota, when they are not the most backlogged countries. This has been happening for years.

I have talked about it many times in the past and have sited this as one of the reasons litigation can actually succeed.
DoS applied country limit across EB and FB and says these countries underutilize quota in FB and hence can overutilize in EB.
But then the same DoS also says (in each visa bulletin) that the limit is not entitlement or quota. In other words no country is entitled to that number. Rather that is the max they can receive.
Thus DoS is in violation of the immigration laws or their own policy.
