    I have just my PERM labor got approved ( employer change labor , original priority date - June 2010 , ) . Confused filing I-140 in eb2 or eb3 , Appreciate any insights making decision to file I-140 eb2 or eb3 . Thank you much.

    I'd say, just wait it out for either EB2 or EB3 to be current for your priority date and just file for i-140 and i-485 concurrently. I suppose u can renew your H1 based on previous company's I-140 for 3 years or current company's PERM for 1 year ( YMMV)

    How could he wait? PERM will expire.

    Based on what Specs said earlier you can downgrade to EB3 anytime if you have I-140 in EB2 but not sure if vice versa is possible. Considering the density in EB2 vs EB3, I would opt for EB3. Also in last few years there are horizontal spillovers in EB3 but not in EB2. So EB3 is best bet based on my limited understanding.

    An approved labor certification is valid for 180 days following approval. The USCIS will reject any I-140 filings made by employers after the labor certifications have "expired."

    EB-3 India will advance two months in August to January 1, 2009. The gap in final action dates between EB-2 India (March 15, 2009) and EB-3 India (January 1, 2009) continues to narrow, leaving only 2.5 months between these categories. As to whether he expects these dates will “flip-flop” as they have for China in recent years, Charlie reminds members that he advanced the final action date for EB-3 India to generate demand for visa usage next fiscal year. Once that demand starts to materialize it is likely to slow EB-3 India’s advancement. The possibility of EB-3 India’s final action date advancing beyond that of EB-2 India cannot be ruled out but Charlie is not able to speculate on this at this time.
    Based on above CO's statement, I'm guessing EB3 can advance upto Jan 2010. Also all EB2-I applications upto March are getting approved, this is a huge sign for future movement.

    It will depends how EB2-ROW approvals are coming in first two weeks of August, if approvals slowed or paused then less movement or else good movement.

    Not sure of 2010 dates will be current in next 1 yr for EB2&3I

    If I were in your shoes, at this moment in time, I would go for EB3. EB3 has much lower density, has horizontal spillover - and is likely to cross EB2I pretty soon.

    Got notification again after couple of hours of first one and this time it says "Request for Additional Evidence Was Mailed". Will have wait for physical RFE to see what is requested.

    If you are current, that would mean you are cleared for approval. But May 2009 EB2I can only pray at this time because it gonna be 6 months before you will see Approval.

    @harepathekaIntezar. My PD is Dec 2009. I am not sure why they are issuing an RFE for dates so far. I am yet to receive the RFE letter , so not sure on what is being asked.

    Guys why the F*** they are sending the medical (I-693) RFE if they are not going to make the date current beyond 15th March 2009 for EB2I and can not guarantee to make it current with in a year?

    This has been happening for the third time for getting this ridiculous RFE.

    Doctors are charging $350 per exam ( $350 * Family members) and there is no guarantee to get the green card.

    Is there any way to sue Immigration for this kind of nuisance?

    I would respectfully disagree. Based on my limited knowledge (my two cents), it only means your file is being worked upon, meaning someone has been assigned (it does not infer anything else), thanks.

    Name updated usually means background check has been completed. That happens to be the last hurdle prior to approval. Obviously it means someone is assigned to the file.

    I have a "name update" and it was a result of changing the law firm that represents me. Nothing more.

    As unfortunate as it is, there is no course but to reply to the RFE. Have your medicals done during the last week from the due date and have them mailed the day before it is due: that way you maximize the validity of those reports.

    One should get the medical done as soon as possible. They are valid for one year from the date of report. You can send them to USCIS towards the end of the deadline. The report is valid with USCIS for one full year from the date they receive it.

    BTW: I have joined the list of late 2009 EB2I folks who have received an RFE. Got text for self and spouse. No email yet. This will be my third medical - and likely again a futile one.

    My I-140 was just approved couple weeks ago under EB2-I (PD May 22,2009) porting from EB3-I. Where do I sign up to get RFE or other notifications from USCIS ? Thank you in advance.
