    Lightbulb "Asking for a Friend" - Questions

    Hi Guys,

    Asking for a friend. He has a PD of June-2014 (EB2-I) and had to join a new company in late 2020 after being laid-off due to Covid-19. He is initiating GC process with the new company and was wondering if he should port his PD to EB2 or EB3 pipeline. Which queue would work out best for him considering the possibility of spillover in Oct 2021 that could potentially push the dates to June-2014?

    Any advice would be greatly appreciated.

    For June 2014, without doubt he should go for EB3.

    Lot of people here will suggest go with EB2 and downgrade when time comes. But all it does is waste a resource which your friend don't need.

    I think your friend should have the courage and initiative to ask the question himself. I can't speak for others but I will never answer these types of questions.

    I had seen many times the friends have so much of personal information of the friend they are asking about. A second layer of security in an anonymous forum may be !!!

    My friend suggest that your friend should not worry abt these things right now. He should start process and get perm approved at highest EB level (1/2/3 for which s/he is eligible) which itself as of now is 12-15month process. Once its approved, then during I-140 filing, pick category which is closets to being current.

    Disclaimer - This is coming from my friend, I just type his/her word. My friend pretends to be lawyer in Internet but can't do a $H1t in front of judge or USCIS. so take this advice with bottle of Tequila, bucket of lime and bowl full of salt.

    This question is for our friend who moved from uk 2 years ago
    His L2 Ead is expiring on March 9. What are his options apart from going on medical leave. He has already done expedite request. His company will start the h1b process from April

    Honestly the first thing your friend needs to do is to get on the forum directly and ask questions. A lot gets missed in translations, unless he has been delegating his work which might be why things are delayed .

    I understand what you said. I am not trying to defend him and I am not here to argue either. But there are some people who do not read forums as my spouse is an example. I have told him to join the q forum. He recently moved from uk and never thought of ead expiring and uscis not responding to expedite request.
    So if any experts have any information on L2 EAD expired and what options he has. Please respond

    It is better to teach him using the forum regarding immigration, instead of spoon feeding. He needs lot of information, and he cannot depend on others for information concerning him.

    I don't know when you had sent the L2 EAD renewal paperwork. A lot of H4 EAD folks have filed for EAD or renewal and are waiting for 6+ months. So it would be very difficult to convince USCIS to expedite (and a ton of recent I485 applicants). I would say a typical EAD renewal now-a-days takes 3 to 6 months. You can look at trackitt to get an idea of who recently got approved.

    As your husband is facing "economic loss" and potential "loss of job", your best bet would be to go through your local congressman / senator. Pick only one person and don't go to multiple congressman at the same time. Present your case to the congress staff that you are facing a difficult situation and ask for their help. If they are convinced enough, they will pull the strings for you. Present family hardship, loss of health insurance, No DL so cant' drive cant get food or any angle to convince the congressional staff. But make sure that you have something to back it up, if they ask for proof.

    I am sorry that you have to face this situation. The US immigration is like a massive aircraft carrier. It takes a lot of effort to keep on things on track, but once you build the momentum things will run smooth.

    Added: Lesson's learned. I would advice everyone to look at the EAD Template Renewal Thread and setup timely 6 month and 7 month reminders before EAD expires. I assure you that if you delay renewal, you will be stressed and praying for a miracle. Why go through it, when you can prevent that situation by sending renewal timely. That's my wisdom based on past EAD renewal experiences.

    Hi Gurus,
    Asking a query on behalf of my close relative. His PD is Dec-5-2009. Got an email from USCIS saying they are reopening his AOS. He did not receive any RFE till now. Should he proceed with 485j and medical or wait for it (appreciate if someone can explain the next steps)? For him his medical was done on 2012.
    Today his SRC12901XXXXX case status updated to Name changed. Appreciate if someone can please help here.

    My relative PD is Dec-2009. He received an email from USCIS saying they are opening his AOS and he is yet to receive any RFE. Should he wait for RFE or can procced with medicals and 485j? Also his case status updated with "Name was updated" on Feb-25-2021. Any idea what is the next step?

    Only Get the immunizations done but don't proceed with the official form filling . Once immunization is done, the doctor can fill the medicals+ plus the GC blood work in a week once RFE is issued .
    Do not flood the USCIS with unasked documentation

    @moveon, i don't think he is flooding USCIS. they have dedicated triage teams to handle incoming mail irrespective of the amount of volume they receive. It is upto the triage team to accept or discard the documentation that was not requested for.
