    EB2 India Prediction Nov 2010

    Dear Members,
I recently joined this blog as I believe can contribute to a few queries posted on this forum.

My priority date is Nov 3, 2010 and cross chargeability is EB2 India.

Can you please share thoughts when it would get current? ..

Per USCIS bulletin of Oct 2017, the real reason USCIS is not accepting applications using Filing Date(of 08-FEB-2009) is due to the reason there are many cases between the current Final Action Dates ((of 15-SEP-2008) and Dates of Filing (of 08-FEB-2009). There is another blog by a law firm which anticipates that USCIS may not allow applicants to use Dates of Filing after the current October 2017 bulletin as it has been the USCIS practice since the Visa bulletin of Oct 2015.

    Thanks.

USCIS opens up the "DF" dates only for the first 1 to 3 months of the year. The DF is a projection of where the PDs will be at the end of the year. As the DF for EB2I was 15MAY11, they expect that date to get current before OCT2021. However, this has almost never happened. They tend to get more applications to keep a buffer in-case more visas are suddenly available to India.

Bottom line with the admin change nobody knows where the PDs will end up. USCIS had stopped publishing pending inventory data.

My personal opinion for all EB2I is to keep your options for jumping to EB3I. People in 2009 know how painful and slow the movement is for EB2I. Even though projections say the dates will jump a year to 3 years, nothing is certain till your PD gets current. If you have a option talk to your management and process another PERM/I140 for EB3I. If you had already jumped companies using AC21, then you need to do a new PERM and I-140 for EB3. If you are in the same company then you just need to do another I140 using existing PERM. In some companies like mine the whole process takes 1.5 to 2 years. After a year of "hiring" they just sent my EB3 PERM. So my EB2I may become current before PERM approval. But I am not taking chances. I would advise you to do two I140's so that you can pick either queue when it becomes FA current. Some people do not like this advice. However, before you know the wait will be 1 year, 2 year and suddenly 5 years. So instead of sitting and hoping, do something to keep your options open. That's what I would advice my family members and doing the same for you. Good Luck.
