Thread: on EAD but H4 problem

    on EAD but H4 problem

    guru's this is for a friend of mine...

    He and his wife both are on EAD/AP since some time and also has H1/H4 as backup and he recently moved to a new job and old employer canceled H1 saying he would be on EAD. Now his wife got a notice from USCIS that her H4 is not valid any more and she need to either do an MTR or get out of country... both him and her has their EAD/AP till 2012 end...

    Now the problem is they are thinking of going for a trip to india and worrying if anything would be problem....

    My personal opinion is that this is not an issue. Since the wife already has EAD/AP, she can remain in the country. Reg H4, I feel the USCIS might have sent it as per routine process since the primary H1 is no longer valid.

    Again, better to confirm with a lawyer using a brief consultation.

    No response is not acceptable so Just have them respond back to USCIS with a copy of valid EAD/AP to prove her status.

    This way USCIS can update their records.
