    Travelling on AP when between jobs

    Folks - A quick question regarding travelling on AP. I will be changing jobs this summer and the way academic jobs go - I will be leaving my current job at the end of the Winter term (end of May) and will join the new job at the start if Fall term (start of Sept). The question is - given that I will be between jobs in summer, is it advisable for me to do international travel in summer?

    I might need to take a trip outside USA during end of June, early July. Just thinking whether there might be an issue with AP with that.

    The only way you might be in trouble could be if
    A) you are outside US
    B) your date is current
    C) you are not employed
    D) and USCIS issues RFE

    Since the chances of B are ZERO this year (IMHO) I think you will be good! Have fun wherever you plan to go!

    Q - You broke my heart! Do we not expect even ~3 months worth of movement this year?!?

    Shouldn't a job offer letter beginning, say, Sept 1 be sufficient if I get an EVL RFE in, say, June-July? Academic jobs are 9 month appointment and summer is usually off.

    I am sorry imdeng. I don't realize sometimes that I speak too bluntly.

    It is not impossible but I am very pessimistic. If I remember correctly Spec has similar observation.

    As per appt letter - I would absolutely think that a job offer should suffice to respond to RFE. But as usual seek Kanamani's advice before finalizing your schedule!

    Q and imdeng,

    At this point of time, as per the latest inventory, I and imdeng are behind 10,500 and 11,500 people respectively. As per Oct inventory we were taking 9000th and 10000th place.

    I still have hope despite the growing inventory. YTeleven guarantees a 15k spillover , I am waiting to hear that from Spec.

    Imdeng, you should be very careful on monitoring the case status at the time u are expected to be out of country. Your offer letter is sufficient.

    So far as I understand, the GC petition is for a future job anyways. So, in my opinion, so long as you have a job offer in hand, your petition and thereby your EAD and AP should be valid. I do not see any issue in your travel so long as you have a confirmed offer that satisfies the conditions of your petition.

    You would probably be using AC21 unbeknownst to you

    This holds true even if your dates become current during the time that you are out of the country. If they do issue you a GC during that time, you may have to get your Passport stamped as such before coming back.

    What does your attorney say?
