    EVL templates

    For the benefit of those who have asked, this is the template of the letter that was submitted for my RFE response.

    Same company with Promotion
    --------
    <Date>

    Employment Letter - <applicant name>

    To whom it may concern:

    This letter is to confirm that <Company Name> currently employs <applicant name> in the position <job title> at an annual salary of atleast $xxx,xxx (whatever was in the PERM). Please be advised that <applicant name>'s job title has changed from Manager to Director but the job duties have remained the same. <Company name> confirms that the terms and conditions of the approved underlying immigrant visa petition and/or labor certification continue to exist.

    Specifically, this confirms the employment of <applicant name>, from <Date of Joining company> to present with <company name> as follows:

    <Current job title> <Date from> to Present
    <Current responsibilities>

    <previous job title> <date from> to <date to>
    <previous job responsibilities>

    If you have any questions regarding this matter, please contact me at your earliest convenience.

    Very truly yours,

    <manager name, title and signature>

    That is a very well drafted letter!

    2 Qs:

    1/ Can salary be described as "at least ____", rather than the actual amount?
    Also, is there any % salary increase above which it is a red flag for USCIS?

    2/ Is it necesary to mention that job title has changed?
    Isn't it sufficient to just say that job duties have remained the same?

    No idea leo. I just put what my company sent my lawyers I didn't have any say in it. Considering I work for a Big 4 consulting firm and use Fragomen as a lawyer, I'd say they have the experience in this sort of thing.
