    primary has to wait 180 days from the date AOS filing was received, to get into a same or similar job with any employer.
    I am not a lawyer, and it's always best to consult an immigration attorney.

    Just to add one more point to Nishant's post.It is 180 calendar days from RD date that will allow the applicant to get AC-21 protection and shift jobs .Also job title need not be same.NOC code however must be same.USCIS nowadays is giving an hard time to applicants to justify equivalence of positions ( NOC code/Title/Responsibility etc ...)

    One would be safer waiting for the GC.

    Does the 180 day rule apply even after you get GC? So, if you get GC in 90 days after applying for AOS, do you still have to wait for 180 days to change jobs?

    My wife's case has been transferred to another office. What does this mean? I am the primary applicant and my case is still under initial review.

    On February 29, 2012, we transferred this case I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to another office for processing and sent you a notice explaining this action.     I don't think so. Some of m yfriends changed jobs after 1 month of getting their GCs. But, I read somewhere that if you immediately change job after getting GC, USCIS will ask about it when you apply for citizenship! Nobody ever verified it, it could be a rumor.

    I don't know about that but one of my friends got his EAD/AP without FP. His FP appointment is next week.

    Acc to la_2002_ch, there are two scenarios, ie getting EAD b4/after FP , in ur friends case it is EAD b4FP, my question was about EAD after FP,

    I am really not sure. But that's what I was told this Morning.

    Also I can't think of any other reason why some EADs with same RD get approved earlier than others (for GC there can be many reasons, but not sure what other type of checks are done for EAD). That's just my 2 cents.

    Background check is usually getting done ( Fingerprint check) by FBI on the same day of FP. Name check is the one taking longer.In my case I got the EAD/AP after two weeks of fingerprinting however my name check does not seem to have completed yet .

    Atleast that is what the L2 officer told me ( well he could not find the FP report as well ) whereas FBI confirmed to me the check was done and sent on same day.It is my gut feeling however that the L1 officers might not be updating the file untill both checks are done.

    Plus, kids (under 18) don't apply for EADs and still they get FP notices. So, I don't think FP clearance is absolutely requires for EAD.

    If you look at your FP notice, you will see app type : 485 and 765 (EAD) but for kids it is only 485.

    ivaarz, as usernamenotvalid was saying, I've heard that the "wait 6 months to change jobs after GC" is not a law, but just a general rule of thumb. The issue is that if you change jobs too soon, that it *might* raise questions when you apply for citizenship. That's the word on the street, at least...

    Man, you were dead right. Just now spouse received additional evidence RFE e-mail from NSC. Did you get yours or do you have any idea what others got? Does the lawyer get the RFE or us or both? (cases filed by company lawyer and we filled out G-28).

    Hi AOS is ready and waiting to be adjudicated. Once current, PD does not really seem to matter although I would love to see them get on order of PD. At least the Year portion of it

    GC Journey coming to a Fruition

    Hello Everyone,

    Just like many who registered - I have been an ardent follower of this blog. My heartfelt thanks to all the contributors. I have got lots of information out of this. Wanted to update on my situation - finally got the GC for me and my wife. We both got an RFE and I wanted to post about that, in case, it helps anyone.

    RFE Details:

    Birth Certificate - We had submitted initially, but we still got it.
    RFE Status on Website - Additional Evidence (so I think it depends on what button they chose to hit)
    RFE Response: Included a copy of BC, Translation (for my wife as it was in hindi), 10th grade marksheet (neither of our BC had father's name in it), standard affidavit from Mother and Father for both me and wife on plain paper and notarized.

    Issue with Wife's BC:
    Wife's BC had extra spaces in Father's and Mother's name - e.g. First Name vs
    • FirstName- this is actually correct. But we had incorrectly filled G325 without spaces.
    • the translation had a typo on the father's first name.
    • Birth Registered after 18yrs


    Issue with My BC:
    • My BC only had initials for Father's and Mother's name.


    I checked with the lawyer about the BC issues and he advised me to include a couple of sentences in the RFE response explaining these. We did that and thankfully did not cause issues and got approved 1 days after RFE response was received.

    As far as employment, i work for a small desi consulting company, been with them for past 7.5 yrs, and worked E-V-C model all the time.
