By looking at the pace at which TSC is updating its "Processing Times", it'll probably only be "May 2011" by this May (2012). In the last 4-6 months, it has moved only once and it was a 1 month move. So, by the time they update the date to Oct/Nov, it'll probably be next year.

    thanks harsha

[QUOTE=harsha131;23461]A valid reason to panic....but by now I believe you have settled a bit, I am pretty sure this RFE is petty and should be resovled within few days. Good luck.

Well we were kinda waiting for my 485 approval to begin our celebrations, thinking it was just a matter of few days....but now looks like its going to be another painfully long wait...i don't mind the wait anymore though....just hope things don't get complicated with RFE....

btw...we are nov filers with pd of aug 2007 and RD 8 nov 2011

I called the uscis and all she said is my case is pending and I would be notified if the background check is cleared!!!! and said to wait and call back outside 4months.

I am not sure if the lower level officer would hold off putting in the FBI check untill the name check arrives, not sure too many variables.

Either way it lets me know not to expect much and just wait patiently untill April/May. The guy specifically told me he cannot open an service request since it is TSC untill May.

    Tackle

You are right !! But what puzzles me is this,a few days back saw Aug 2011 on the processing times for TSC.Today when I look at the link it shows April 2011 for TSC.

I-485 Application to Register Permanent Residence or to Adjust Status Employment-based adjustment applications April 3, 2011

So by May 2012 TSC will be processing May 2011 applications....nice tactic by TSC to stonewall SR's.

Well that is the situation TSC filers right now have to deal with...huge amount of luck required for just the checks to come through properly and to be arranged properly by the lower level officer in the file

Do we need to refile PERM if I change my client and be with the same employer, once 485 is filed and is pending less than 180 days ? My contract is coming to an end and I need to find a new client. Any help appreciated.

Check with your lawyer how your PERM was filed. Consultancy companies usually mention that employee will need to work at various client locations across US.
In such case PERM location is HQ of the company.

  15. #3015
I think the location is usually the client location and perms are filed for more like regions (e.g. tristate) and if that or the job responsibility changes then a new one needs to be filed. Better to check with the lawyer on this especially if relocating.

Typical consultancy companies its very rare that PERM will be filed for client location as no one knows how long the current contract will run.
And ofcourse , check with your lawyer on every step you are taking or going to take.

Thanks suninphx and manzoorraza, I'll am going to check with my lawyer tomorrow.

In case of H1 sure one needs to file new LCA when client location changes. In case of PERM it would depend upon how it was file and may not be necessarily be refiled if client location changes.

Finally my turn has come on a special leap day! got the CPO and decision e-mails this afternoon at 2.30pm. Been in U.S. for more than 8 years and was getting a little frustrated seeing later RD and PD approvals. However, no updates for dependent and her I-485 still shows Initial review. Anyone else had the same situation?

Congrats billu. Yep, same situation here, I got my approval but my wife's status kept showing up as Intial Review for a couple of days. After that it turned to Request for Evidence. I hope that doesn't happen to you. We are still waiting on the RFE mail. Haven't received it yet.

PS: Saw the same thing with a couple of posts on trackitt. Primary gets approved but dependent's status shows up as RFE after 1/2 days. Good luck!

    ead status

My ead status was "card-production" yesterday; also I received emails saying "we mailed the new card directly to the address we have on file"

and today I received email "On February 28, 2012, we mailed you a notice that we have approved this I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION. Please follow any instructions on the notice."
and the status changed back to Post Decision Activity.

Is it normal ? Can status change backward ?
    I'm confused now !!
