    Polapragada,

    Did you read my reason? I have an India ticket blocked and MY CHILD is left back in India due to the sudden craziness of date movement. You would know if you have a child and if she is left back 4000 miles away.

    And FYI, my GC is NOT going to come any sooner because Jan filer's file is not going to be picked up anytime soon and + everything is Priority date based and I don't care much for the EAD coz we have very stable EXCELLENT jobs. No issues there too. I just need to go get my CHILD back ASAP

    Pls. do a spell check before you comment on my situation. Thank you.

    As far as i know we can not miantain both EAD and H1B status at the same time..here is a link from murthy site.

    Chat User : Informative website, Murthyji. Thanks for the service. Once the EAD is approved, what do you have to do to change from H1B to EAD? Is approval status on the USCIS WebSite enough or do we have to receive it?

    Attorney Murthy : A person has to receive the EAD in order to work for a new employer on the EAD. Merely having an approval notice or seeing the approval status on the USCIS WebSite is not sufficient to be able to work legally on the EAD. A person does not need to do anything to switch from H1B to EAD. Merely by working for another employer on an EAD, a person is deemed to abandon the H1B status and opt for the EAD, unless the person requests the new employer to file an H1B petition extension with the new employer, in which case a person maintains both statuses at the same time, which is legally permissible. Only after travel abroad and reentering the U.S., a person has to choose to enter as a parolee or on H1B status, but, then, as stated above, one may revert to H1B status by filing an H1B extension even if one enters as a parolee, if one is still working for the same H1B employer.

    Congrats Sandeep and what_ever. Looks like NSC is on Roll. Hopefully we all should be picked up and transfer to the green basket. I am still waiting on physical EAD card though I got approval notices couple of weeks back.

    Hi,

    Got two emails from USCIS on primary(spouse) I485 and I765 with similar messages. For I765 it was :"On February 22, 2012, the post office returned the notice we last sent you on this case I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION as undeliverable. This may have serious effects on processing this case. Please call 1-800-375-5283 to update your mailing address for this notice to be re-sent."

    As I mentioned earlier the company attorney received all six notices (3 primary + 3 dependent) while we received only 3 notices for the dependent alone at our mailing address (which is/has been the same for more than 2 yrs). We are pretty sure that the forms carried the same correct addresses so not sure why this occurred. Apart from calling USCIS is there anything else that we should do to prevent any further problems or hiccups?

    Anytime now. Only factor against you is your ND is late, meaning your RD also might be late. Right now they are seeming to be dipping into December first week around.
    My Rd is Dec 15 and notice date is Dec 19. Also, TSC has gone super slow in the last 1.5 weeks. They were on a roll during the first week or 10 days of Feb. These last few days are really hard to get by because you know you are so close yet so far.

    Btw, now you can enjoy an awesome St. Patrick's day..paint the town green

    I am sorry but I disagree with you. I was not the one to start it. Again, going early for FP for Jan filers will not change a thing in processing times. Without getting the facts, it is not correct to comment.

    Congrats to you as well Sandeep .Looks like NSC is rolling in hard again ...very impressive that even after updating the processing times they are confident of 4 month window which means every Dec NSC filer will hit the sweet spot by early March. If not for anything they will make sure people will get greened to avoid the pain of an SR/Senator pressure etc .

    TSC on the other hand to borrow a term from my mother tongue should be named Tagubothu Service centre ( J/K no offense meant to TSC filers...Tagubothu means Drunkard....TSC reminds me of Jackie chan's Drunken master and also reminds me of the famous Drunken man problem in Probability...one step rapidly forward...two steps backward ) .

    I can see a method to the madness with NSC(RD and PD combination with some luck ) . TSC on the hand totally random and refuses to update its processing times cleverly to avoid service requests from filers.

    My 2 cents on early walk in. I know I have also been criticized earlier on the forum for this stand

    Everything is fair in love and war. Early walk in helps your processing done faster. I am live example of it. I got my GC before my scheduled FP date, because I did FP early walk in.

    If ASC allows early walk in, and stakes are high as is for EB2IC who live in constant fear of retrogression, and some folks have valid personal reasons too, on the whole I personally understand both sides of it, and am not going to criticize person who did early walk in.

    All my life I was afraid of trying anything out of ordinary, making any special requests, staying on straight line religiously, always agreed to whatever was thrown at me. This time I did make phone calls for SR for FP, I called to obtain tracking numbers, I did early walk in, and was prepared to do anything and everything allowed to me.
    I am not a lawyer, and it's always best to consult an immigration attorney.

    Which in fact very well true as the more and more we ponder over it we try to be creative giving unique names, but it is because of the frustation rising out on the helplessness of us post the filing..

    I was under similar assumption that once having used EAD (even for part time) one would lose their H1B status until i spoke with my attorney.
    Having had this strongly wired into my head i am a bit optimistic now after doing some more research on various forums.
    It appears that one can use EAD for part time purposes and still maintain H1B as long as the conditions in the LCA are followed.
    I still have to do more research and crawl through some more lawyer forums.

    I did early walk-in too, and I have a couple of reasons for that...
    1. We got two different appointment dates, 4 days apart.
    2. The ASC is 70+ miles away and the appmt is at 9am. Given the erratic winter weather conditions and the morning traffic into the metro, I was worried that the chances of missing the appointment are very high.

    To preempt unnecessary complications, I decided to walk-in on a day and time that is more convenient for me. I'm a Jan filer and with PD in mid 08 and I don't expect early walk-in would in any way benefit my case.

    With the NSC stand on processing time I am sure most of th Dec filers would be greened from now and sometime in March....though TSC says 9 months somehow i think they are playing safe....hoping TSC starts approvals starting from tomorrow for Dec filers....last thu/fri/sat TSC was very active for Dec filers.....

    As Nishant mentioned Early Walk In definitely helps.....if you are 'allowed' for an early walk at your ASC I recommend for it.....

    Thanks for the wishes Sandeep.I am done with my FP and did it on the date that was assigned to me . I had tried for early FP in mid january but was turned away at the ASC, at that time did not know ..one could try at nearby centres. I wish had done that because that would have literally shaved off 3 weeks of background processing.

    Anywaz hope TSC starts looking at Dec filers soon.

    It is not a question of ascribing names . TSC has not been really straightforward in updating its processing times preventing people from generating Service requests. Also the pattern of approvals is based on early FP + RD dates throwing out the concept of PD.TSC is approving March 2008 guys leaving July -Dec 2007 guys standing.

    Also since you are in the mood for zen wisdom let me also try one nugget of wisdom.

    Nishant, Congratz on your GC! Loved reading your story.

    Your situation (Dec/Nov filer) is different from Jan/Feb filers. PDs were swept across a whole year (almost). As of today, ASC is still processing only November and December Filers. When my file is picked up, regardless of an early walk-in or not it would be processed at the same time. So, there is really no difference what so ever and I am not causing harm to anyone by going in early and ONLY because my personal situation demands so.

    If I were allowed to do an early walk-in Feb 2nd week, is my file going to be picked up and I get a GC in 3 weeks (like you?) Honestly No because ASC is still processing Nov and Dec filers.
    If I went on the scheduled appt date of Feb 27, is my file going to be picked up late? No.

    So, really for Jan and Feb filers, it makes no difference + FBI turn around time is 24 hours.

    I agree, there is more predictability to the beast with NSC than TSC, if we can use the word predictable that is.

    NSC is going by RD a whole lot. Within a period of RD they are looking at, all the dates that are current at that moment, are "allowable" without regards to PD.

    Only quick inventory making, retrogression, gradual movement in batches, can control ordering by PD, that is my conclusion. Right now is bonanza time though, and those who get lucky, are akin to have made hay while the sun shone oh so brightly for them.

    It is not a question of ascribing names . TSC has not been really straightforward in updating its processing times preventing people from generating Service requests. Also the pattern of approvals is based on early FP + RD dates throwing out the concept of PD.TSC is approving March 2008 guys leaving July -Dec 2007 guys standing.
