    All Gurus,

I have a question on AC21..I went to this forum and others searching for all the info but gotsome conflicting answers ..This is my question

    - Almost everyone suggest to keep the H1B status even if one gets EAD. It is better for appeal if something happens to the 485 filing
    - 180 days after the 485 filing one can change a job by invoking AC21.

    If so,
    - What paperwork new employer needs to do?
-How can one maintain H1 status if the new employer is not required to transfer the H1
    - If the new employer needs to file H1 , what is the advantage one is getting by having EAD. This can be done post 180 days after the 140 approval too.

Any reply in clarifying above is well appreciated.

Good start for Feb on Trackitt 6 NSC EB2 I approvals, 1 from TSC this filing is from Jul 2011. Looks like new numbers were infused in the system when the month started. Lets hope for more good news today.

What paperwork new employer needs to do?

There are no specific forms, applications, or petitions to file to invoke AC21 when it is used. There is a general expectation that the USCIS be notified when there is a job change. It can be done by sending a job offer letter with a similar/ same job mentioned in the perm but not necessarily same exact salary in the perm along with the I-485 Receipt notice.

How can one maintain H1 status if the new employer is not required to transfer the H1

You might have come across the importance of H1b as a pending AOS beneficiary after reading this forum and others. So if employer A is not ready for H1b transfer then go with employer B who is ready to file H1b.

If the new employer needs to file H1 , what is the advantage one is getting by having EAD. This can be done post 180 days after the 140 approval too.

If you change the job after/before 180 days of I-140, you should start your GC process again right from perm . Portability law comes into effect only after AOS pending for 180 days.

It happens when one of the moderators posts something and by mistake checks the box that says "close the thread".

So the last post of a closed thread will always belong to a moderator

Just a general question about the FBI name/ background check. Is there any pros/cons in having a not so very common name?

I understand in the reverse case, it may take longer for them to review and sort out.

    Just a follow up question/infer

In short having EAD gives one the benift of NOT asking his future employer for sponsoring his greencard and that in turn may increase his marketability.

Other than that this doesn't give any advantage to the primary employee as far as a job move is concerned. The new employer should sponsor his H1B transfer and all those attorney expenditure..I am not sure this is well understood by everyone by looking at the ectasy of EAD arrival.

You don't have to maintain your H1B once your EAD comes through. It is merely recommended as a back up to keep yourself in status in case your I-485 is rejected for any reason. If you are eligible for AC-21, and have a great offer from an employer who does not want to file for your H1B, you would need to decide if the risk of I-485 rejection is high enough to warrant turning down the offer. In my opinion if one's application is straightforward, the risk of I-485 rejection would be very low, so I would accept the offer. Probably most folks have a similar risk tolerance to me; hence the ecstasy on EAD arrival.

Just saw on the *** site that one of the Jan filers from TSC got his EAD Approved. Maybe TSC is now picking up (and maybe steaming ahead of NSC) atleast for EAD approvals.

There are certainly reasons behind the happiness for getting EAD, most of the primary applicants have qualified H-4 spouses who could make use of the EAD .

Not necessarily every primary applicant wishes to maintain H1b as a precaution for potential denial, I have seen several 2007 filers' who are solely working on EAD and changing their jobs .

With EAD-AP combo card we could avoid stamping while travelling even if EAD is not used.
