Thread: Post 485-Filing

I didn't go through every page to see if this was posted. But my theory is they are creating a pool to make sure there is no wastage in visa number. On the other hand everyone who gets an EAD has to be renew it every 1 or 2 years and hence keeps the renewal fee coming.

    Good Source of funding.

They did it for last 5 years since 2007 and continue to do that for people in EB3 IC.

    Just my 2 cents.

    EAD/AP to the lawyer address

Is there an option to send EAD and AP to Lawyer address rather than my own? Because I will have to move soon and not sure what to do.

    Is this even recommended?

its beneficial only for immigrants not USCIS. as long as Visa numbers wont change/ any legislation change your PD and GC go hand in hand( earlier PD's get earlier GC),hence having EAD/AP for you and your dependants boosts your confidence, you can make decisions/invest etc also down the line after 6 months, you are eligible to find suitable job rather wasting time for steability...

Under the new fee structure since post-July 2007, there are no renewal fees for EAD or AP. EB3I folks who continue to pay fees, filed their I-485s in the July 2007 fiasco. So USCIS makes no money from renewing EADs and APs with these new I-485s.

I have seen this kind of post across several different immigration forums. In order to attribute a reason to USCIS building a pipeline, folks are coming up with all sorts of reasons from the weather to fee generated from EAD/AP renewal. This is a very common misconception all across several forums on immigration. USCIS DOES NOT charge anything for EAD/AP renewals past July 30,2007. Read top left part on page 8 of below document (Point 4 says that if u applied AOS after July 30,2007, no fee for renewal of EAD/AP card is required):

    http://www.uscis.gov/files/form/i-765instr.pdf

So,please read and spread the word.

The reason for DOL building a pipeline or inventory is guess what??? ...they dont want visa numbers to get wasted due to inefficiency of USCIS unlike past years. Any other reason provided for the rapid movement of dates is pure and absolute BS.

    Some other misconceptions are:

early walk in for FP will expedite EAD/AP process (biometrics are for 485/GC)

Green cards are issued based on Receipt date and not Priority date (USCIS pre-adjudicates cases based on RD but DOL issues visas (GCs) based on PDs and visa availability)
NSC PD: Oct 25, 2007 RD: Nov 3, 2011ND: Nov 8,2011 FP notice date: Dec 2,2011 FP completed date: Dec 12,2011 EAD/ AP approval e-mail: Dec 14,2011 I-485 approval E-mail: 29 Feb ,2012GC recvd:5 March,2012 Dependent I-485 RFE E-mail: March 1,2012 RFE received by attorney: March 13,2012 RFE response mailed : March 16,2012 RFE response review status e-mail: March 19,2012 Dependent CPO: ??

    Update

After speaking to my wife's lawyer we decided against filing 485 again based on her approved 140. However her receipt for 485 filed as my dependent has my PD. So I guess it should be okay. Still waiting on EAD/AP for both from NSC even though we filed on 15 Nov,2011.

I am trying to see if that is normal? my lawyers are going to talk to USCIS too.

I filed my 485 requesting all documents to be sent to the lawyers office and I have been receiving all the documents from my lawyer. Just yesterday I picked up the EAD/AP combo card for spouse and self from the lawyer. Earlier I was cussing myself for directing all docs to the lawyers office, but now I see some virtue in it. Just recently we received a letter that was intended for a house a few numbers away and my wife questioned me about the possibility of our EAD/AP/GC/RFE etc. being dispatched to the wrong address. At that time I did not have an answer, but now I think I made a good decision to send all communication to the lawyers office coz there is a better chance that your docs will reach correctly at your lawyers office than at your address. Sometimes when your mailbox is full, the postwoman simply leaves the mail outside the door - that wouldn't happen at your lawyers office. That's just my opinion, others might think differently.
