This confirms that they started not only processing but approving pd's from Oct as well.
Do we have any one who got RFE's among us recent filers.
I hope, my attorney will take care of anything in case of RFE, since I am India right now.

Hi,
My PD is current as of Jan 2012 bulletein.But my 485 papers are sitting on attorneys desk for past 3 weeks for EVL.
Currently my employer has been delaying in giving the EVL.
Now since the dates moved by a year in Feb-2012 bulletein , would it adversly impact my appl if i am able to finally submit in Feb as i would get a Feb RD , where as somebody with a later PD than mine , could get an earlier RD.
Does this scenario effectively mean that i eventually end up getting the GC after somebody whose PD was later than mine.
Please advise.Thanks in advance.

Q, I believe that apps are processed in order they are received. But since allocation of SO visas is to be in order of PD, DOS would at some point retrogress and make dates current in batches of few months based on their inventory and SO allocated. Hence GC would follow PD order to a great extent. However in inventory building mode, like right now, some AOS folks cud get lucky out of order as well as CP folks definitely.

Nishant, apps are processed in order of PD predominantly i.e. everything else being equal. If one is stuck in FP and other is all through then the first person even if is from 2005 may not get ahead of the other who may be 2007.
So yes RD matters... but only when both people are nearly same PD with same level of case complexity. Then hte person who filed first will get processed first.
Another time when RD will matter is when the entire category is current. So yes of course then RD is what matters more than PD. But for backlogged countries, USCIS and DOS do try to keep sanctity of PD as much as they can.

So from your replies I can infer that a delay of a few days in eventually getting the GC could be possible because of the delay in submission but if all other things (assuming both cases are clean / no RFE / no other issues FP etc) remain same between two candidates , their PD would obviously decide when they get their GC.
So in my case if I am finally able to submit my appl in late Feb , I still would not be hurt as much by the late submission as anybody with a PD may be 6 months after mine would still be behind me in the GC queue though with an earlier RD.
For a moment I even thought of checking with attorney if I can submit my package without an "EVL" (& thus risk a RFE) & just lock in my RD & then send the "EVL" as & when its available. Such a helpless feeling owing to inability to travel for past 4 years owing to visa uncertainties.The "EVL" is probably the last thing employers control in this process.
Issue with PD printed in I-140 and I-485 RN
I had an issue with I-140 under EB2-I having a priority date printed as 08-Oct-2005 instead of 08-Oct-2008. Law firm which is handling my case sent a letter to USCIS to correct the issue but we did not receive an updated I-140 approval notice.
I became current in Jan 2012 based on 08-Oct-2008 PD and I applied for I-485 with the original copy of I-140 (which had a PD of 08-Oct-2005) and the notice we received has the same 08-Oct-2005 PD.
Question is: will this be an issue in case the cut off dates retrogress in the future and I-485 gets approved based on 05 PD instead of 08 PD?
My PD is Dec 2007 but I could only file in Jan second week. This was due to delays at both my employer and Attorney. What is the time period to receive receipt number after sending the applications. My attorney said its couple of weeks. What is the general trend for Nov, Dec and Jan filers.

You are one lucky guy i guess. I don't see any issues. The better part is they have to pick your case when it is ripe since your PD shows 2005. If all documents are in place and IO is comfortable approving your case you will be greened pretty soon. Good Luck.
