    Got my FP done and now waiting.
    Is anyone seeing GC approvals or no?

    Different observation with NSC. The photos on the EAD/AP are the ones submitted with the I-485. The fingerprints are marked as unavailable.

    All really depends on the kind of QSP that can be allocated. Now the SOFAD trend is not very encouraging so far, all Nov filers will be approved this FY but the process maybe quite slow. The Oct filers group is only 2K while Nov filer is close to 8K. It will take anywhere from 1 - 6 months for Nov filers approvals. The approvals will be quite random is the dates stay without retrogression, RD & ND will also play a role besides PD and of course NSC is faster than TSC.

    Same here as I got EAD/AP card before I got FP done.

    EAD/AP do not need the FP, if it's there, they might use them I guess.

    Mostly NSC I believe except for 1 case.

    Secondary applicant is in the US currently on H4 and will be filing.

    Question is, if secondary applicant is employed in an Indian company and working in India, is that an issue while filing I 485.

    Lawyer's questionnaire has this question : If currently employed abroad, provide the employer information. I would like to know if this will be an issue

    However, there is no such question in the I 485 form itself?

    Why does the questionnaire contain so many questions that I 485 does not have?

    This is an extremely important form, and is needed for 485 adjudication.

    I would have lawyer's opinion on answering the question, but my view is one should answer it truthfully, and be prepared to explain any situation in detail if asked in an RFE.

    if it's your attorney's questionnaire then you can probably ask him directly. I think you can answer as "N/A", since the secondary applicant is already in US and on H4.

    EAD/AP Validity

    Guys,
    Is there a change in the EAD/AP validity? i was under the impression its valid for 2 years. Now i see some folks getting them for one year? Does USCIS decide the validity(based on possible visa numbers) or do we do it on applications? I dont recollect entering anything on my applications but i m not sure if my lawyer did.

    RMS, you are welcome. I feel afraid in saying more of my views, as I don't want to give false advice, but my gut feeling is, that it should be fine that you are working in any other country, a person may work remotely or visit periodically etc., at the most you should be prepared to show letter from your overseas employer about employment details and show tax returns of the country in which you paid taxes for that employment. The thing to find out is, is there any tax burden on the applicant in USA if he worked for someone outside of USA.

    I also think that the employment history asked for is to verify status and background check information, and if you worked for say something like a nuclear energy company in foreign country, etc, and I would be really hard pressed to believe they would be interested in knowing salary and tax returns of foreign employment. But definitely it gives something to the adjudicator to ponder over if he is scrutinizing.

    I think the rule of thumb is:
    - If your PD is current when they issue the EAD/AP, it will be given for one year
    - If your PD is not current due to retrogression, then they will give for two years

    hmmm...i m borderline case for GC ...from H1 renewal to EAD renewal...let the extension applications pervail

    I was planning to travel India by end of January 2012 using Advance Parole but I'm not sure if I should. I'm concerned that if there is an RFE (as my dates are current) then it would be helpful to reply back if I'm still in US. Do you have any suggestions?

    I want to have some peace of mind while I'm in India. Do you expect Oct filers getting GC this month?

    I'm totally confused. Need help.

    So when does this adjudication or pre-adjudication (sic) happen?

    This is what I understand

    1. 2 weeks after ND, receive FP notice
    2. 4 weeks later u go for FP
    3. Within 90 days from ND, you "may" receive AP and EAD

    What happens next when
    1. dates are current
    2. dates retrogress

    Does Pre-adjudication begin as soon as FP is done and the final approval only when Visas are avble?

    Does it mean if I get my EAD, I am pre-adjudicated?

    Thus far except for 1 case all approvals have been from NSC, TSC processing time is 6 months while NSC is 4. However irrespective of the processing time I think you should get greened in the next 2 months as most cases get resolved well within the timeline. Your date should also stay current even if there is retrogression. I remember your case since the trip is really long cherished its fine; EAD / AP there are normally no issues. If you have not booked your tickets then if you go after 2 months there is high likelihood that you will go with your GC itself. If there is a RFE your attorney can take care of it and you can correspond via email, you can check the online status hopefully.
