Thread: Post 485-Filing

I got RFE on 485, I dont think we'll get ant RFE's on EAD Level.

by the way, I don't know on what I got the RFE for, My status has been updated as Initial Evidence needed. I am waiting to see what they are asking, in the mean while I want to check how people have responded to Flu vaccine RFE

    Sirisha,
Did you get the RFE on EAD or 485? Appreciate your response.
And I've one more doubt. My PD is JULY 14 2008, so now in may bulletin if it retogress, and if I submit my RFE before may, is there any chance that I get GC after that.

like will they allocate Visa number when they touch our file and send the RFE....

    Thank you Imdeng and Sirisha.

Per my understanding, the Visa number allocation is the last step that happens before card production. I wish you good luck.

This is just my opinion. I am not an attorney. Pls consult with your attorney.

That's right. No visa allocation = no card production

Did anyone hear of any 2009 PD getting a GC yet? What are the odds that before the retrogression kicks in there will be some outliers from 2009 who will sneak in. I was skimming through trackitt data and looks like approximately 1 in 5 of Jan filers have been processed to one degree or another approximately all the away upto end of Jan receipt dates. Theoretically, if the retrogression happens in May bulletin it would only kick in from 1st May so there are still 35 days left for anyone who has filed to have a fair chance, especialy if FP/BC get completed without any issues. Just trying to see if there any believers who think we might see some of 2009's getting lucky. Any thoughts?

So how much time it takes for BC to complete after the FP date? 15-20 days?

Should It take that much Time. FP is for FBI to process fingerpeint and name check. Quote from FBI site: The majority of name checks submitted are electronically checked and returned to the submitting agency as having "no record" within 48-72 hours

I think Background Check might take more than 48-72 hours.

The Department of State (DOS) has advised that the EB2 India and China category will retrogress to August 15, 2007 in the May 2012 Visa Bulletin. Charles Oppenheim, Chief, Visa Control and Reporting, has provided this information to AILA.

The EB2 cutoff set in the April 2012 Visa Bulletin, which is May 1, 2010, is not changed by Mr. Oppenheim's announcement. The changes will occur in the May Visa Bulletin. We at the Murthy Law Firm will provide our readers with further analysis in an upcoming NewsBrief.

If we receive EAD with FP on it, does that mean FP/BC completed? Or just FP completed?

That is not an indicator of whether or not BC is done. That doesn't mean that is hasn't been completed.

Quick question on RFE issue and 485 process. Once RFE is issued ( say for example RFE on BC) and the corresponding RFE is responded, do they re verify the whole process? Rather what takes place post RFE response?

kramacha, your RFE response goes back to the same officer who was adjudicating your case, so the officer does not need to re-verify everything. When the RFE response is received, you regain your place in that officer's line, so adjudication after that usually happens quickly (generally couple of weeks or so).
