    AFAIK, biggest hurdle for a faster/ slowere BG clearance is the length and commonness / higher hit name. If the name is longer system tries to jumble u r first middle and last name and search.

    Your last 5 years of residence is a starting point for check and not the end, they check from the second you entered the country even if u lived here for 50 years,,,,

    The IBIS check is the background check. The FBI Name check is to see if your name has come up in Federal Investigations either as a primary (main) or secondary. I think IBIS and FP are really quick. Name checks can be a pain if something comes up the first time around. This is where having a common name hurts you.

    Length of time in the US shouldn't matter much although the more I read the more it seems that the longer you've lived here the greater chance of an issue in the various checks. Bottom line is that if you've got nothing to hide, then its really up to chance as to when you will get approved.

    Theoretically, if all is well, one should get a GC 45-60 days after RD (assuming one is current). But that's not usually the case as we are seeing with Nov and Dec filers.

    Unhappy Post 485 questions

    Hello everyone,

    I am newbie and need some help.

    I have just applied after long (10) years of waiting with PD Feb 2008. I would appreciate if you could help me with the following concerns.

    1. When I filed I didn't give the copy of the OLD passport which was expired in late 2008. However, it had all the history visa and stamps since my first entry in 2001. ---- Would that create any issues? I asked our company legal rep and she said it is not needed prior to applying. (fyi..our legal reps are not lawyers, they send the work to other lawyers)

    2. I have been traveling to canada by road and they haven't been taking my I-94 while leaving USA and while entering USA from canada by road US Immigration officers were allowing me back with the previous I94 ... As I understood it is not needed to handover the I94 and receive new I 94 upon entry while traveling by road or crossing border by road. -- My question is .....
    I didn't put those entry exit in the filing - would that cause any RFE?


    Please advise...I am freaking out ...after long wait....on the top of this there is a retogresse coming(

    I think this could be some concern if your case officer is having a bad day. But as long as you have lived by law - do nt worry. Things should be alright.

    I think it would be great value to add some more info to the PDF. Such as
    1. days to wait before calling uscis for each stage status update or to raise SR, eg: say receipt, fp notice, EAD, status check on on 485, etc.
    2. contact numbers for FBI fp check, uscis contact.
    3. info needed before calling uscis, such as receipt number, etc.

    All January filers who got greened heartiest congratulations!!!. For others like me, I know it is tough to patiently wait and to top it all there are these concerns about retrogression. hang in there.. all i can say is elephant has passed it is only the tail left to pass thru..

    Not to scare you but it would have been a good idea to include copies of old passport..my lawyer was also of the same view but I insisted and got it added to my packet..better more than less. Cross your fingers, maybe your case will skim by, depending on the IO.
    Or as somebody mentioned before (4 similar profile friends case), that getting an RFE is actually better, at-least your case will be moving...there is always a positive side..

    The requirement is to have a copy of the passport with the latest visa stamp on it AND your latest passport. The I485 instructions don't explicitly say this but again its interpretation and mood of the adjudicating officer. So I think you should be ok.

    About the entry-exit, I don't think they will be that stringent about Canada but if it does happen, its not a big deal.

    VSC 485 processing dates move back from 4 months to August 14, 2011 and for TSC it is June 2, 2011 .... 485 processing times for vsc and TSC published today

    Point 2 is not a problem. Even if you travel by air they don't take the I-94. I travel once a month to Canada and my lawyer request me to retain I-94. There something called Automatic Re validation and this is legally allowed

    Thankyou all for all the compassion you showed when I shared my story. Until my I-140 was approved - I never knew anything about the immigration blogs... Started googling around and initially found a crap load of forums where the discussion was loud and noisy - with very little information.     Quick question:
    With expired H1 stamp on passport can one travel to and from India on AP. No intent to use EAD, planning to continue on H1 but do not want to go for visa interview and stamping.
    Would it raise any issues??
