    I have a job offer and have an option to work on EAD and H1b. Which option is better?

    I just got an job offer and the HR gave me an option to work on EAD but they are more keen to do a H1b transfer. I am wondering which option is better? I also have H1b extension in process applied by my current employer. My EAD expires on March 7 2015. One of the reasons the HR gave me is that the if the EAD renewal doesn't come on time then I can't work and the other reason is that my H1 is invalidated once I start working on EAD.
    Is working on H1b advantageous becauseof the following reasons ?
    1. it's a back up plan in the event something goes wrong with my 485 application.
    2. in case an RFE is issued for my 485, the new company lawyer can represent my case.

    Would appreciate any response from people who have been through this before.

    anasha - welcome to forum. I will tell what I understand but as you said - it would help if somebody who experienced this could answer your questions.

    1. Yes indeed using H1 is much better because it protects you in case GC application is denied.
    2. If you use EAD, I do not think that your H1 will be instantly invalidated. But I do not know when it does become invalid. But I know for sure if you don't use H1 then the remaining time on H1 can be reclaimed later.
    3. You can use EAD and work independent of the fact whether you are working on your current H1 for the old employer or not.

    work on H1, keep renewing your EAD.
