    Passport linked to the I-94 issued at port of entry

    I entered US through the Mexico border with my old/expired passport with H1B visa valid till Sept 2015 stamped in it. I was also carrying my freshly issued passport. However, the I-94 that they stapled on my passport is linked to my old passport in their system (I checked it on the CBP I-94 retrieval site).

    Should the I-94 be linked to the old passport (since my valid visa was still tied to the old passport) or should it be tied to the new passport?

    My understanding is old passport it the right thing that they did. That's why they ask that people should carry their old passport with you when travelling.

    I would be interested in learning what others think.

    I called up both the CBP posts at Mexico border and Philly airport. The post at the border said it should be with the old passport however the Philly guy said it has to be the new passport. However, the Philly guy seemed to be in a hurry and am not sure he understood my question in its entirety. I'll probably visit Philly airport in person tomorrow to figure this out.

    I am not an expert at this. But why should this even matter.

    Old passport has the Visa and its ok if they used this in your I-94.

    Ideally it should not. However, the DMV lady was confused when she tried to look up my record for license renewal and eventually asked me to sort things out. Also, want to really avoid giving CBP a reason to send me to secondary inspection the next time I enter US......
