    Hi, my PD is 02/08/2013 and received and responded to RFE. My status changed to 'RFE response review'. My PD is current in September bulletin. Is there any chances Am I going to get green card in this month?

    using 6% conversion rate, its 4433 so far,
    today my anxiety and need for GC sky-rocketed after I realized that I could lose my job any day,

    Previously in spite of concurrent h-1 and ability to do 2 jobs, I left the old employer in august 2011 with whom I could have applied for 1-485 ( if I remained few more months in the job) during last Frenzy (late 2011) and by the time I got new I-140 ( with old PD retained) the dates retrogressed.

    I just found myself rather in a very uncertain situation that I just don't want to start new job search and application etc., as it takes about 2-4 months from the time of applying to actually finding one and I am worried about the consequences if I were to lose this job now.

    My question is if I have a job offer letter by the time of 485 approval, will that be good enough as actually starting to work it might take couple of months and moreover most employers find it easy to give employment letter ( in fact there is a Philippine doctor with whom I worked before who has business of his own considering giving letter) as long as they don't have to actually send it to uscis as I think AC21 filing is just optional.

    Please ask for any clarification, I am just stressed with anxiety and not sure if I can make it through finish line this time ( I have decided to stay in job unless fired this time)

    I'm very sorry to here the situation you find yourself in. Hindsight is a wonderful thing, but no point looking back.

    It appears your RD is April 2013 (are you sure that shouldn't be April 2012), which would put you in a very difficult position. If you have already passed 180 days, ignore paragraphs in blue.

    Until 180 days have passed since your I-485 was received by USCIS, you have no I-140 portability and are wholly reliant on your current Employer.

    If USCIS adjudicate the case within that time and ask for an EVL, only one from the sponsoring Employer will be satisfactory.


    Once 180 days have passed, you will have AC21 I-140 portability and a genuine job offer from another Employer should suffice to answer any RFE for an EVL. A small delay in joining the Employer should not be material.

    If your RD really is April 2013, then, you would be very vulnerable if you lost your job and received an RFE for EVL. In truth, it means you would have to start the PERM and I-140 process again with any new Employer.

    You really need to reach that 180 day mark - the options expand after that.


    Best of luck.

    PS I think, given the mix of PDs approved, the figure is about 4k to date, almost equally split between 2007 PD and earlier PD. My weighted average currently is about 7%.

    Hi Spec,

    Thank you for your service to the fellow members. I have one question. I am currently on EAD & my PD is 05/20/08 which will be current in Sept 2013. Before publish of the bulletin, I received offer from another Employer which is very encouraging. Now the dates are going to be current I am hesitant to join before obtaining GC.

    Is it ok to take the offer after getting my GC immediately since the offer was pre-existing? What are pros & cons?

    Indiani, you'll probably get your GC at any moment, and then none of this will matter. In the event you lose your job before you receive the GC, you'll still be safe. You've just responded to the EVL RFE a month ago, so i can't see them asking you for another.

    If you are a FTE then some companies offer severance package. Should situation arise you can check with HR if there is an option of delayed relieving date instead of severance package. That might take you past 180 days. I hope things work out for you and you won't need to go that far. Good luck.

    You are almost certainly correct. Thanks for pointing it out.

    My initial reply assumed he had passed 180 days, but I amended it when I saw the RD he had given. I didn't think about the COD at the time.

    Given the very different consequences of the two dates, I'd still rather give more information than make an assumption (albeit an almost certain one). I have altered my reply to ask the question.

    I'd agree that in normal situations getting RFE is a good thing as that is an indication that an IO touched the application. But in the case of the mass RFE, it must have been an automated system that triggered RFEs for applicants that satisfy some specific conditions. In that case, I don't think RFE or no-RFE doesn't make any difference. In fact, applicants without RFE might even have an advantage. But we can never tell.

    Not Spec, but i'll summarize the views of folks on this forum:

    To be completely conservative and safe, you should stay at your GC sponsor for 6 months following approval of I485 and not have a paper trail indicating a plan to move before hand. However, many here feel that is too conservative a view and that you can move immediately after receiving a GC if you need to. The argument goes that since AC21 allows you to move prior to the GC, it's intent of course carries over to after you had the GC too. Just collect and save evidence that the job is similar to your current one and perhaps some communication with the future employer that there is willingness to file an AC21 application if your GC hadn't come through (although even filing the AC21 doesn't seem to be strictly necessary).

    Still, remember that we're not lawyers so you want to talk to a good one (one that's uptodate with latest memos and case law) before making a decision.

    My status shows Decision with the following info. My wife's status went from RDE response review to RFE this morning. Not sure what they are asking, but am happy regardless.

    On August 14, 2013, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.

    During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision.

    Congratulations, great news to see a old timer finally get greened. Hopefully its a simple RFE for your wife since your dates will be current in September it is likely for her to get approved fairly quickly do turn around the RFE response ASAP.

My only guess regarding my wife's RFE is that her passport expired in January 2013, which we renewed before it expired. USCIS probably might be asking for the new passport copy. Just a guess. I'm hoping it is this simple. Regardless, I'm happy at least one of us got approved and our files were touched.

    Also, yesterday was my daughter's 3rd birthday. I was secretly praying that something good happens on her birthday.

    I received a response from USCIS on my service request that I opened 2 weeks ago. Anyways , nothing new . I asked them specific status on my case if everything is reviewed and ready since RFE responded to back in 2012 .

    " The status of this service request is:

    Recently, you or your representative contacted USCIS concerning your I-485 to notify us that you believe your case is outside of our normal processing time. Below is a summary of what we found and how the issue has been or may be resolved.

    Your case is now with an officer. We regret that we are not able to give you a timeframe for when we will complete the review.

    My application for I 485 is filed and I see that the check is cashed but not image is available the transaction is seen as USCIS DALLAS PAYMENT 130812 1903 PJPMC############. Looks like they are doing some electronic processing instead of regular check processing.

    Received response on my congressional inquiry

    Friends , I got a response to the query initiated by congressman on my inquiry .

    " The case is with officer pending clearance and adjudication " .

    If it is pending clearance after 19 months since filing my 485 , I'm not in much hope that it will be cleared before dates retrogress . So until next cycle, I plan to stay detached to receiving GC . Good luck to all our friends here with pending 485 approval . Continue to raise SRs and follow through to set right expectations .

    Don't give up hope. I had exactly the same feeling like you do until this morning. I was going to write to my senator in the next few days and already drafted the letter yesterday evening. But, I received the magic email this morning. I'm pretty sure TSC is now trying to catch up and will get to yours sooner or later.
