    Lightbulb Job Change Prior to 180 days

    I changed jobs before 180 days . But my I-485 is pending for 16 months and the I-140 has not be revoked which was approved in 2008. The employer who filed my I-140 is not revoking it.

    Can i file AC21 and give a Current employers EVL??

    Currently working on H1B with the Current Employer

    Got the 14th June RFE for EVL

    Need urgent help on how i should proceed

    I don't see any problem whatsoever since you did and are using H1 with new employer. So technically your AC21 starts now - IMHO.

    But I would suggest - just for the sake of peace of mind, pay a lawyer $500 or something and have him respond to RFE.
