    Travel while Biometrics RFE is pending

    Gurus,

    I need your expert advice on my situation. My son just turned 14 and we received an RFE for pending 485 asking for Biometrics fee. We paid the fee and awaiting the biometrics appointment. It is more than a month. My son needs to travel out of the country for about a month starting next week. My concern is can he travel without giving the biometrics ( he gave the biometrics once when I485 was filed)? If we get a Biometrics appointment while he is out of country can we ask for reschedule? Do we anticipate any issues while entering back on AP?

    Your prompt advice will be highly appreciated.

    The biometric requirements for someone under 14 are different to those required for someone aged 14 or older, so he will have to attend a new biometrics appointment.

    Yes, you can request the appointment to be rescheduled, so you will need (or someone) to keep an eye out for the appointment letter. I don't think you can specify a date for the new appointment and I don't think USCIS are obligated to accept a second request to reschedule the appointment. If the absence is only a month, then he should be back in time for the new appointment.

    The pending RFE should not impact his ability to reenter the US using AP.

    Can you please clarify what you meant by "I don't think USCIS are obligated to accept a second request to reschedule the appointment"? I am assuming that USCIS will generally accept for one request for reschedule and I still do not make it and make another reschedule request they may not accept. Is my understanding correct?
