    Travelling India during H4 to F1

    Hi,

    My sister is on H4 & she applied for F1 in Oct 2012..It's been already 6 months, but there was no approval. Now she got an intern & she is on H4.
    What will be the options for her?? Can she go to India or any other country and get it stamped??

    WHat would be the future steps for her so that she wouldn't loose her internship??

    Rajiv - welcome to forum. I believe you mean - there is no decision (either approval or denial). I also assume she has filed for change of status from H4->F1.

    It might be best to sort this out while staying in US - just in case there was some issue with her case. Because otherwise going outside might complicate things.

    I would say - since internship is so critical for one's career - get lawyer's help. Have a lawyer followup with USCIS and get the answer. If you can't afford a lawyer - ask USCIS yourself.

    When I did my internship (about 10 years back), just having F1 was not sufficient. I had to apply (via school) and get an EAD for my OPT and CPT programs. Looks like that is still the case:

    I think schools have the best information and on this. They also tend to have conatcts on USCIS side and can offer better advise. I would suggest to speak with Internation Student Services... all schools typically have one. Good luck.

    infoseek raises a good point and that could open up a possibility.

    Both OPT and CPT provide you EAD. I think there is a possibility that one can get OPT or CPT based EAD based on I-20 issued rather than the F1 status acquired.

    I am not very confident about it - but check if this can be a possibility at all.
