Lightbulb Is It Possible to Go Back To H1B From EAD?

    Hi Guru's,

i got a quick question, I am working on an EAD, my H1 will expire in couple of weeks.
1.Is it possible to work on H1 again, i mean going back to EAD to H1?
2.if H1 expires, is there a way to get new H1 and work on H1 until i get my GC?

please move this question to appropriate thread.

    >>>>>>> Sure its possible. If company files a H1 for you, then you can be on H1.

    >>>>>>> Yes. Same process. Let your company file H1 petition. Once approved, you can work on them on H1. Its automatic transition.
If the GC and H1 sponsor are one and same, then think of H1 and EAD as parallel work authorizations.
please move this question to appropriate thread.

    gkjppp,

i think you can certainly use H1 before it expires. After it expires you can possible request an extension to that H1 based on your pending GC.

However I am doubtful if you can get another H1 with another employer. I am not sure about that one.

Someone recently asked a question regarding changing employers on already expired H1b

It is possible to transfer a H1B to another employer even if it has expired long back, provided you are eligible under AC21 portability rules( Porting H1b to another employer after I485 pending for 180 days under AC21).

    Here is the memo...http://www.uscis.gov/USCIS/Laws/Memo...ntrm051205.pdf

    Go to Section I V question 1.

Please direct me to the appropriate thread where the original post is posted.
