EB2 Predictions (Rather Calculations) - 2012

Gurus,

A small question, One of my friend is working with Company A with H1 and has a valid EAD in EB3 as Programmer. He is now chaning the job to a new company B to Project Lead position.

1. Can he move on H1 status. If yes, what happens to EAD? Will it be abended?
2. Can he still port to EB2 and use the same date?
3. If he moves on EAD, how can he port to EB2?
4. Is it better to move with EAD status or H1 status?

Please suggest, this is critical for him as he need to join the new company next week.

Its a straightforward case for your "friend" !!! I always wonder why some of our "friends" can't ask these questions themselves!

Anyway none of my business..... but the answer is very very straightforward.

Your friend should transfer H1 as well as invoke AC21. He should rather NOT use EAD. And finally if possible he should pursuade the new employer to file another green card in EB2 and then when 140 is filed, use the EB3 date (that's what porting is).

Given this data .... the chance that we will see significant forward movement for March bulletin is 100%.

An interesting thing to observe is the 2005 EB3I demand. That is the place where the impact of porting is clearly seen. It will be interesting to see how much of post 2007 EB3I demand is there today.

ps. Another thing would like to add - given that Oct demand should start hitting pipeline approx 4-5 months - that means expect next demand data around 7th
March to show significant demand. Will it be enough to slow or revert the advance of EB2IC dates? I can't say.

Congratulations many to those who got current. 1st May 2010 means people with PD from including 1st January 2010 upto including April 30th 2010 are eligible to file for AOS in March 2012 for EB2 IC categories. And anyone with PD earlier than 1st January 2010 is still welcome.

Demand Data still showed very low numbers, yet CO only opened gates for 4 months, two months less than the proposed 6 months he said earlier. It means that definitely, there is some math or logic behind his moves, I can't say what they are.

IO can request visa number for an adjudicated 485 if the PD is current at that time, and there is no overriding memo by DOS. I feel that even for next demand data, we won't see big numbers unless DOS sends a memo in between to USCIS informing that they are going to block visa number demand for PD greater than a certain date, in their software which assigns visa numbers upon demand. Otherwise numbers would never creep up in demand data.

I think that frankly, this might be followed by a period of pause, and then retrogression. I do not think there will be abrupt retrogression in next visa bulletin itself.

I also think chances of movement in next visa bulletin are very thin. CO did not put any comments this time in the VB.

Really feel for folks on 1st May 2010 onwards, but guys, remember that if really demand destruction is high, you guys won't face as much of a frustrating wait as we folks did, in amount of 4-5 years. But a headwind for you will be the improving economy.

ps: This is also great news for December 2011 EB2IC filers, especially from NSC, and even TSC for that matter. We got two more months now for adjudication leading to a approval.

March VB moved only 4 months to May 1 2010 compared to 6 months prediction by CO. Looks like a stall or retrogression is on the way. I wonder how far the dates will be pushed back in 2008. Demand data is not helpful compared to 485 Inventory.

One thing to note in this VB, unlike in the past few VBs, there are no predictions of any sought, interesting!

Maybe they are leaving all options open! We can all keep speculating until next VB
