Thanks. I think turbotax asked for her AGI(she is switching from ITIN to SSN). Which I used from last years agi. So the suggestion is use (0) for her Agi and I should be good to go.
I went to the local IRS office and asked them to link the ITIN to SSN but they asked me to mail the document and said they do not have access from local office to merge the two. But advised to use SSN for tax filing.

Sounds good.. Just put in "0".

TT needs AGI and SSN to create a Pin for e-file. Since they don't have a SSN-AGI link from last year, you are getting the error. Hence, SSN + "0" will work.

Do 485 and EAD have independent timelines? I got my FP notice and later got RFE(2 photo) for EAD. For 485 they got the finger prints and digital photo. Why should they ask for photos after they have my digital photo? So will 485 processing time get affected due to RFE on EAD?

Thanks. once I enter O for spouse and procees. it asks me to select a 5 digit e filing pin. Do I select a new number or leave this blank? Does this new number become the efiling pin for future efiling?

My understanding is that the two timelines are separate. Your RFE on EAD should not affect your 485 processing time.

Mine is not available but it seems it will be available soon.

BTW I was talking to my attorney today and he said it is not completely impossible that you will get your GC by Apr 30th. It seems now it is totally luck - who picks your file, how straightforward your case is etc etc.

He also said that since I applied on 1st Feb and haven't heard back from them so it implies Background check, name checks are all fine.

Generally you need the same pin to exile next year but you can always get a new pin with the SSN and AGI. IRS has a micro site and TT will take you there.

Dont Worry Buddy, My sons AP was delivered to my attorney Yesterday. They callled me and informed that they recieved it. No news on mine and Spouse. Check with your Attorney. It will be with them...

Looks to me like there is something changed in your Case and so it became Available. I believe you will get GOOD News soon...

The important thing to notice is your priority date: 2009! This is a good news.

So I finally got my EAD in hand. *throws hands in air and shouts yayyy* Ahhhh what a relief. The super smart mailman had put my card in someone else's mailbox. I got hold of him today and asked him to open all the mailboxes and check !! He did that and found it in the neighboring mailbox. Felt like giving him an earful but controlled myself as all my future mails are in his hands :) Though I have a valid H1 and dont need EAD to work, it has been stressful for the past 3 days, calling up USCIS, lawyer, going to USPS, tracking down the mailman. Glad its over. Now I hope I am the lucky one to get the GC by April 30 as a compensation for this lol.

Did you guys try to get a new SSN card post GC approval?
Our SSN card has some remark that needs work authorization from INS or something like that.
I read an old thread from trackit that we should apply for a new card. Is it required?

Good news that all is sorted out with your EAD. Don't get greedy (or your hopes up) for GC. I'm a Jan filer and will be touch and go (and more likely no-go) so like i said, don't get your hopes up.

You never know dude. There is this user gccrave on trackitt who is claiming that he just got his GC, and he got current in Feb 2012. He was still waiting on EAD. At the time of writing this post, he has not disclosed his PD or other details so far and everyone is very curiously asking him as I type this. :)

Sorry guys, have been tied up with work in the past week or so...so less activity here. I have been checking my 485 recepits everyday twice and so far there is no movement there. With reachme_s's progress I am starting to have hopes of it working sometime soon; although, as a lot of people have pointed out, luck is going to matter a lot on who gets in in these last 33 odd days left before the retrogression kicks in. i dont think you will get a new card per say... but the restrictions on your existing card would be removed in the system...

RFE response review status

Hi Teddy and other experts:
Wife's status is stuck on RFE response review since March 19. According to the reports, the visa numbers for EB2I/C have been exhausted. No new approvals , even for RFE cases, since March 23 on trackitt too. Do you think we will see approvals starting next week or will have to wait till October 2012?

Dependent job change question

So my wife is the dependent on my 485. She's on H1 right now expiring in May. We got our EAD already. Other details are in signature.

Question - can she change jobs and use her EAD without any issues to the application.

I think she can but wanted some input.

time will tell but if not in April then you will get it in the summer. Won't have to wait till Oct.

RFE was asking for an EVL. Recd on 3/26, responded on 3/27, status changed to RFE Response review by EOD 3/28.

Of course your wife can use her EAD without any issues to the application but again being on EAD means that you both are solely relying on the I485 app to maintain status (unlike being on H1-B to which you could fall back on if something happens to the 485 app). But the answer to your question would be Yes.

Wife going on EAD does not change the status of the primary applicant who can continue being on H1B. If 485 gets denied then wife will have to switch to H4 assuming that primary has maintained H1 till then.

Guys, My PERM application indicated that my job title since June 2008 was Software Engineer, but the I-140 application indicated that the job title has continuously been Product Manager.

I got EAD card this week. If I want to switch jobs after 6 months and invoke AC 21, will I have to go back to the PERM title or can the title be the one mentioned on i-140?

I hope I can take the latter title because I have not touched software development since Dec 2008 and am kind of out of place in that.

Q. My wife is on H4, If she moves to EAD will it change her H4 status. Answer: No
Q. If I enter using AP, will it change my H1b status. Answer: No

I didn't say why? I didn't want to go into any non-immi vs immi vs some dual intent thingies I had some ideas about. I just wanted confirmations.
