You might have come across the importance of H1b as a pending AOS beneficiary after reading this forum and others. So if employer A is not ready for H1b transfer then go with employer B who is ready to file H1b.

Just a follow up question/infer
In short having EAD gives one the benift of NOT asking his future employer for sponsoring his greencard and that in turn may increase his marketability.
Other than that this doesn't give any advantage to the primary employee as far as a job move is concerned. The new employer should sponsor his H1B transfer and all those attorney expenditure..I am not sure this is well understood by everyone by looking at the ectasy of EAD arrival.

You don't have to maintain your H1B once your EAD comes through. It is merely recommended as a back up to keep yourself in status in case your I-485 is rejected for any reason. If you are eligible for AC-21, and have a great offer from an employer who does not want to file for your H1B, you would need to decide if the risk of I-485 rejection is high enough to warrant turning down the offer. In my opinion if one's application is straightforward, the risk of I-485 rejection would be very low, so I would accept the offer. Probably most folks have a similar risk tolerance to me; hence the ecstasy on EAD arrival.

Just saw on the *** site that one of the Jan filers from TSC got his EAD Approved. Maybe TSC is now picking up (and maybe steaming ahead of NSC) atleast for EAD approvals.

Oh Loe. Thats bad TSC. Yes this wait kills me too. i think if its only me who thinks this..looks like you are with me:). on NSC side i see many approval whos PD is 2-3 months ahead of mine. so by god grace we should see our approval soon. Brother GChopeful123, Sogggadu and Nishant and T - How do you feel. Does this wait and approval kills you. I took a break for 2 days just to avoide this but cant wait.......?

There are certainly reasons behind the happiness for getting EAD, most of the primary applicants have qualified H-4 spouses who could make use of the EAD .
Not necessarily every primary applicant wishes to maintain H1b as a precaution for potential denial, I have seen several 2007 filers' who are solely working on EAD and changing their jobs .
With EAD-AP combo card we could avoid stamping while travelling even if EAD is not used.

I have been on edge since Fri, I keep on refreshing this and the trackitt forum for any new info/approvals. The wait is especially killing because people with PD before,same and after me have been getting approvals (god bless them). Was just hoping i get it this week so that I can get an excuse to empty some six packs this weekend. Lets hope for the best. Positive nervous energy is good, it keeps the heart healthy :)

Friends I hear you. Sogaddu had posted an analysis from Trackitt which indicated that most of the NSC filers are also waiting; however atleast NSC is very actively on both Oct & Nov cases. Yesterday there were 6 NSC approvals on Trackitt all Oct and Nov while only 1 from TSC that too from Jul. Even today there are a couple of NSC approvals some people have posted on the thread but not updated Tracker. Hang in there looks like all NSC Nov filers should be greened this month if FP is completed. For TSC backlog seems to be huge and we can hope for something in 2 months probably unless we are lucky, they are moving mostly by RD barring a few exceptions. Good luck to everyone. Also let’s hope to see a good VB again with forward movement.
i agree with teddy bhai on this... i guess at this point we have to regroup our energies and work on something other than immi stuff... thats why i always advise to pick a fight with the wife :-)... you have to give ur 100% in a fight which you wont even win!!!! cheers... Lets wait...

@Pedro Gonzales -> No issue. Wife and I walked-in. We did not bring up the appointment topic at all. Turned in the notice..followd the instructions..It took longer than I anticipated..about an hour..unlike 10/15 mins people where mentioning..
@Codesmith -> I dont know if it matters..I just did at my first oppurtunity when I had no meetings at work..MD in my signature is when my attorney mailed out my application..

Codesmith this memo from the USCIS states it as 12 weeks (84 days) . 30 days is for Notice of Denial.

Usually all lawyers try to respond within 30 days to avoid issues.
Soggadu's post about travelling on AP while RFE has been intiated on I-485 got me thinking.
The general consensus on Trackitt and other forums is this.Other users on Trackitt even spoke with USCIS reps on the phone.

1.RFE on I-485 does put the processing in suspension untill the RFE is answered satisfactorily.
2.RFE on I-485 does not void the AP and one can travel on AP.However if it is NOD ( Notice of Denial) it voids it immediately (obviously )
3.CBP officers at the POE will not apply the rule always uniformly and there will be and have been cases of people being sent back.
The silver lining however is this...one gets 84 days to respond to an RFE and that should be more than sufficient for most of us to respond to one I guess.Still better to be careful while travelling on AP.

I especially want to comment about the rules not being applied uniformly. While that is a problem / fact of life by itself - the discretion and sovereignity of IOs is also an important point to always remember.
An IO's decision to refuse entry can't be challenged in court or anywhere else - as far as I know. That decision is final. So theoretically you can have everything in order (valid visa and GC and everything) and an IO can still refuse you an entry and nothing can be done about it .... other than try your luck at another port of entry and/or another IO.
Just something to remember.
As per the original concern that soggadu relayed - yes I do think that AP shouldn't become invalid just because there is an RFE but it would provide a reasonable cause of concern to an IO that is admitting you at a port of entry.
Good to be back in the familiar warmth of the forum :) Q . I totally totally agree with your post and this cannot be emphasized enough. The IO's have tremendous powers and one needs to factor this scenario in their worst case calculations.
Trackitt has many such horror stories and unfortunately they are true.

My 485 package reached USCIS Texas lockbox on Monday and I received text messages and email (G-1145) about an hour back (Friday early morning - probably some batch program triggered it). Here is the text of it:
Dear Applicant/Petitioner:

Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number SRC12901XXXXX. Yep that was quite a wait given that folks from Dec at TSC were getting approved, although theoretically i shouldn't be complaining as i am still in the 90 day processing period.
My best wishes to all those who have been approved in the interim as i was avoiding the forum per my therapist recommendation :p
Now the real wait starts.....
