I re read on murthy's site and found this.
"There is a possibility that the EB2 cutoff date in December could be even more favorable than March 1, 2008. Since cutoff dates are based on estimates of demand, the DOS will use data regarding early November 2011 adjustment-of-status filings (Form I-485), prior to establishing the December cutoff date. The cutoff date movement in the November 2011 Visa Bulletin permits a large number of individuals to file for adjustment of status as of November 1st. The DOS monitors the filings to determine whether anticipated demand matches the actual demand for visa numbers."
If that is the case then they will wait for more time to get idea. Or they can go up to March 2008 this month and in Jan they will use nov filling as pivot point to decide how many they will get in Dec.
They can't use oct since that was most favorable date in 2007 and only give them PWMB .. but Nov can give them full idea of average demand per month.
Lets see what he does.
So far the approvals have been extremely lukewarm at best. The 11/02 approval is EB2 ROW the guy is from Germany and the 11/01 approval is from someone with a Sep 2006 PD who had an interview so must have had a cap number reserved for his case kind off when his interview was scheduled. Besides that I read of another one which is again ROW - Cross chargeability. It’s still early days however if we do not see many approvals then it is indicative of numbers not being allocated. There were still 2.5K cases available by the last demand data. QBF what’s the news on MITTBS.

T, I checked MITBBS these days and there is ZERO approval in November. I think maybe the total approval is close to the 26% of EB2 annual quota. Maybe they stopped approvals and will resume in the next quarter in January. Nobody knows what's going on. Maybe they will start approving in this Friday?
It is very ridiculous! Many of them got GC in 1 year or less, we are getting GC in 5 years. Now they are complaining............
In the same industry, the competition is unfair. In the same company, one Korean guy got his GC in several months and jumped to a better company. one Indian/Chinese guy has to stick to a low pay job for 5 years or more before advancing in careers.
It's like a Chinese guy has a rope attached to his testicles and the Korean guy has no rope attached and these two guys are boxing on the stage. The Chinese guy can't jump because he feels the pain whenever he jumps. Now the Chinese guy asks the judge to release this rope to have a fair competition with the Korean guy. The Korean guy complains to the judge: don't release the rope, let his testicle pain continue.......
Guys with out my fault and because of my employer's mistake back in 2009 , I was out of status for over 2 months . My employer withdrew my visa and didnt tell me . He told me 2 months after he did it and I rushed to apply for h4 since spouse on h1b and h4 got approved , got an h1 with a new employer and then about 1 year transferred h1 to my current MNC corporation. I have an M.S from a reputed university and about overall 3 h1b's and 2 h4s all approved. Now as my spouse primary is readying to file for 485 next month ( if current for Dec PD 07 Ind) , jitters running through thinking about those 2 months of out of status. I had already put this question to this forum earlier and Q was kind enough to answer. I'm fearful of any rfe since that year I did not have payroll run for few months and dont have pay stubs if proof is sought. Since that incident I have no t left the country or traveled outside . I confronted my ex employer and he said since I'm not the primary applicant I should be ok . Any thoughts from gurus ? Now I'm also wondering if in the form somewhere I should accept that I had been out of status or not .

Do we need to have all the tax return copies when filing I-485 ? if so how many years copies do we need ?
Check with your attorney if he is submitting tax docs. Not every attorney is submitting them. I guess it depends on case by case or the size/reputation of the organization filing GC. The last part is just my conclusion, by seeing so many other posts, of course :)

I had spoken to my company's immigration lawyer after the incident and when I went for my visa stamping. His take was "no criminal offense" was a HUGE plus in my case.. Hopefully everything should be ok..

When the attorney asks for the tax returns, is it only the Federal returns that we have to provide??? Is my understanding correct or do we have to give the state returns as well? I can ask questions to the attorney only after my date is current.

I have a same problem with my wife's H4 Visa. My employer's name is miss-typed on her H4 visa.(ie. instead of "ABC", they wrote "ABNC"). Do we have to correct it? My concern is if we go to consulate they will give us 221(G) and then we don’t know when we will get her passport back. FYI, she already has her returned ticket.
Should it create any problem in future immigration process or port of entry? Please advise.

Thanks Pedro. Except for that one blip , I dont think I have had any issues with my immigration. Are you supplying all of your spouses visa approvals or 797s or just the current one. It gives me some confidence since they had approved my h4 despite the delay. If I'm so unlucky that they zero in on that specific scenario , then not sure what kind of proof I can get possibly . I'm hoping they will breeze through . Yes I do have an attorney so let's see how it goes.
True. My Attorney asked me to submit only the most recent copies of I94, I797 and Biographic pages for my wife (I am the primary applicant).
I read some where that, if some one is out of status, they can go out and get the Visa stamped. This will resolve their out of status issue.
Moreover the back ground check revolves around the primary applicant, but it doesn't mean that they will not check the legal status of dependents.

I have a question.My H1 elapsed last month(could not extend it because of lack of ead /6 year completion/ my GC did not advance until I140 ) hence applied for H4 visa. All I have is a receipt for H4 that it is applied. My spouse priority date is feb 2008 under EB2I. In case if the dates become current for applying for 485 should I need to have H4 approval or does the receipt suffice.
A friend of mine was in a similar position back in August 2007.. He had applied for H1 extension and it was in process while his PD became current.. his lawyer submitted the receipt as a proof of his current status.. His H1 was approved about 15 days after he submitted the I-485 application. When he went for the biometrics, he carried his approved H1 and a copy of it and told the officer about it. He handed over the copy to the officer, at the time of biometrics.
He was expecting a RFE about the current status, but didn't receive any. His GC was approved recently. The officer must have updated something in the system or he could have received an RFE for a different reason (that I'm not aware of) and he updated it in the system.
I guess your situation is similar to his, so you should be fine.
Stepping in to Nishant's shoes, I can very well understand the situation. My PD is several years from being current, still when the VB comes out, its like my whole life depends on it. Now take that and exponentially increase it and see how it feels like when you are 8 days away.
