Post I-485 Filing - RFE's Discussion

I have got an affidavit from my parents for a name change on my BC ( i have an extra initial on BC, which I have since dropped). but looking at the RFEs here, I am wondering what else I should prepare just in case.

my issue is that my school certificates, till my Xth exams show the name with that initial. want to be prepared in advance, since back home my parents have medical conditions and may not be able to run around for me at short notice.

any suggestions? as always this forum is a great support for people in Q..

I think any one. I will check this now.. But on the requested docs i dont have anything to prove my name and my parents name together as i am from TN. Can i resubmit Affidavit again?

My attorney mentioned that if there are any problems with BC (no name, late registration etc) - then it is best to provide some secondary evidence (School Records, Hospital Records etc) and then two to three tertiary evidence (Affidavits). I guess USCIS is looking for some secondary evidence - 10th Certificate, School Leaving Certificates etc. IMO - the list is an OR and not AND - but more you can manage the better.

How much time have they given you? Best wishes to you in getting the response ready and filed with all required documentation in time.

Both my attorney and I received the RFE letter. I received the email on last Thursday, actual letter on this Monday.

That was quick in just 4 days. IEB2 got RFE on the 10th and got details today Iam hoping I get it tomorrow being a day behind. Watch out for the LUD once USCIS receives the RFE response.

Yes Teddy. I got alert on 10th( Friday). My attorney got the letter today. Surprise the letter was dated on 13th . so i assume even for you it shd on 13th(Monday) and i m sure tomorrow you will get it

Thanks Imdeng. I can submit my school leaving certifcate but i does not have my parents name. so not sure if that will be use

Check with your attorney, but here's what I'd do:
a. school leaving certificate
b. Ration Card or Election Card or house hold card or property documents or any government papers
c. Notarized affidavits from parents and relatives stating that above two ( a& b) are correct to the best of knowledge.

My case status changed to "RFE Response Review". God, this wait and these multiple instant messages are killing me:) I even got two ims for my H1B approval today...which btw was filed in october :) You can imagine my heart-beat monitor :)

Dont worry Leo, you should be fine.... as your RFE also was only on BC.... i am thinking the decision will be done soon

Leo Congratulations that the RFE response reached USCIS. The fact that you got alerts for H1 is actually very good, as part of 485 approval that last status is updated as cancelled / redundant and that may be the cause of the alerts. I would bet that you get CPO either today or tomorrow now.

Thanks IEB2. You can add the following to your case

1) Marriage certificate that will have your parent’s name.
2) Your wedding card in case you happen to have it.
3) If your parents worked in the central government they will have a CGHS card.
4) Pan Card / Photo Id card for voting.

I hope I get the RFE details today.

We received our RFE letters and they have asked for a copy of our BCs. That is all they have asked. I'm thinking yours must also be BC related.

strange, I'm thinking that someone might have misplaced bcs in bulk while reordering them. Or have put one bc into others files that they have to request BC for all.

Yes and this is not new. My cousin who filed during July 2007 fiasco, got RFE for his wife to submit BC in 2009, although he had provided the same when filed. So this has been going on since a while.

Maybe some BC look like garbage to them and they trash it initially :)

I'm almost sure that yours is a BC as well. Get your documents and response ready to go. So that you can file the same day you receive the actual letter.

I'll not be surprised :) May be it's just a strategy to see if we old timers are still interested in GC or have left the country by now :)

Friends I received the RFE details for me its EVL + BC and for my wife it’s just BC. Surprising that we submitted the BC's (Imperfect ones) along with affidavits at the time of filing. They have simply asked for BC or its equivalents just a simple one line. Not sending EVL was my attorneys call, I believe my employer should be able to provide it; I have been with the same company since coming to US. Just sent the details to the attorney let’s see what they have to say now.

@Teddy. Thanks for the update. Get your documents ready and push it out as early as possible next week.

Not providing EVL was simply a wrong call. I believe it's mentioned as part of Initial Evidence in the 485 instructions.

Completely agree with you, unfortunately for me this call was taken by the attorney and since he is the company attorney I could not do much. My HR manager was more than happy to give the letter but the attorney was adamant that it is not required. Like you Nishant also pointed out the same that EVL is mandatory the rest is just my bad luck.

@leo and @indiaeb2 thanks guys just waiting to hear back from the attorney. I will do my part ASAP. One good thing we did after filing is that both me and my wife now have newly issued birth certificates which we can send along the affidavits and the old ones. Will go with the lawyers advise. I was really expecting it for the flu shot but that passed.

My attorney just received my RFE. Its for a flu shot. Going to try and turn it around today.

Quick question for Those with flu shot rfe. Did your doctor fill out a new 693 form or just modify the existing one and sign and date?

I'm sorry that you received RFE for such a silly reason. But at the same time, I think it is good that the RFE is silly and could easily be addressed.

I remember reading somewhere that for RFEs related to Medical Certificate, USCIS sent back the MC envelope along with RFE notice and we had to take it to civil surgeon, have it updated and resealed. But I'm not 100% certain. I just remember reading this in some forum.

On a related note, can you please tell me if your Civil Surgeon left "Influenza" column blank or marked it as "Age Inappropriate"?

ram they will modify the existing one ...sign and date. i just done this saturday

Mine was marked as age inappropriate.

usually as soon as they receive it.My attorney filed the response on 15th, it changed the status on 16th. Of course stayed there, ever since.
