Thanks..LOL...Tomorrow, the office staff will see "Rajnikanth" and soon the employer will get a sense of reality and learn to be respectful of others ( even though as H-1 employee we are "supposed to have equal rights" but that's rarely the case)
Even though AC 21 porting to self-employment is an option under EAD I know of only one friend who did it but in general I don't like the idea of ever being "employed" so I will slip into the self-employed position be a "good employer" soon..
Congratulations to you and your family. Must be feeling very relieved now. Enjoy the moment you have been waiting for. Iam sure your employer's tone is going to change on hearing the news. First and foremost ask them to file an I9 with GC this way you can record that you worked with them post GC and then its really up to you how best you can demonstrate the goodwill intention to stay with him and make a graceful exit. Believe me a lot of people have gone through this agony of waiting for GC in a terrible work environment, now that its done Iam sure you will be over it and gain strength out of it and move on to the next chapter of life towards a rewarding career and a job that you like.

I'm hoping I don't miss the boat again this year. I called USCIS last thursday and opened SR as it has been 60 days since the status changed to RFE response review. I was told that the SR will be assigned to an officer within 15 days and I should get response within 30 days.
I have also sent requests to my local Congressman and my Senator. I haven't heard back from my congressman's office yet. However, I did receive a reply from Senator's office (postal mail) saying that they'll be working on my case and that by law, federal agencies have 30 days minimum (:confused:) to respond to inquiries from Senator's office.
I just hope one of my initiatives would at least get someone at USCIS to dust-up my application and take a look at it. I just want to know what is holding up my application. Should have been a straight forward case. I've been in the same city since 2002. Straight EB2. Working at the same company (formerly Fortune 500, now Fortune 1000) since 2005. Have had no trouble with the law. So, I'm just not sure what is holding my application up.

Do we have any numbers regarding break up of TSC approvals in terms of original EB2 filers and EB3-EB2 upgrades?
I am trying to figure out if USCIS is done processing most of direct EB2 folks from 2007 and if most of the people who are still waiting to be greened(after becoming current on 1st Aug 2013) are EB3-EB2 upgrades like me. Also, do you think USCIS will be trying to finish pending applications with priority dates earlier than 1 Jan 2008 before approving new applications which will become current in Sept 2013?
I understand the logic for USCIS officers going for low hanging fruits (i.e direct EB2 folks) to increase their productivity/bonus/other incentives.
But, since EB2I dates are expected to retrogress some time soon and then not move for another 9 months , won't the EB3-EB2 upgrades that are left out this year face the same problem next year of not being low hanging fruit and missing out again to direct EB2 folks.
May be I have become a bit skeptical after not seeing any updates on my case (Dec 2006) till now and thinking too much. Any thoughts:mad:

As you might have already seen, approvals are pretty random. There is no order to it. The reason it seems like straight EB2 cases are being picked before EB3-EB2 porting cases (with an earlier PD) is that there is just too many direct applicants when compared to porters. So, the probability a porting case gets picked is much less than the probability of a direct case gets picked. I don't think "low-hanging fruit" theory is the reason for this. As far as I can tell, USCIS handles the cases that are current with the same priority regardless of PD or RD. I'm not saying this is fair; but this is the reality. So, once you are current, all you can do is pray that your application gets picked. If you expect USCIS to process the applications in an orderly fashion, you'll be sorely disappointed.

There is some anecdotal evidence from the Trackitt approvals that, to date, it has been slightly better to be at NSC if you have an earlier PD, but I wouldn't rely on the figures as terribly authoritative.

I don't think you'll need to wait that long. Most SR responses seem to say that if your application is with an officer, you should hear back within 45 days. Assuming your application is with an officer (and that it got there before Aug 15th), you should see your card before the end of September. And in any case, I think the 45 day timeframe probably includes a huge cushion. The only potential problem would be if they issue an RFE when they finally process your application.

I have a quick question for August approvals -- did almost everyone receive the June 14th RFE for EVL? I was chatting with my attorney a few days back, and he'd mentioned that the % of EVL RFEs is still pretty small - less than 10%.
Curious to know that the general consensus/experience has been on the forum.
