my birth certificate has a birth date as Oct 5th 1978 but my actual birth date is Oct 8th 1978, Even my Passport and all my other certificates shows date as Oct 8th 1978. Can some one help me what steps should i take to get the birth date corrected . I was born in india.

If you are losing sleep over it tehn go to a lawyer (personal or company one). But personally if I were in your position, I would simply trust common sense will prevail. They will go by your passport date. Worst case they will issue an RFE.
p.s. - Believe it or not, I have stamped my H1 without all the required documentation. The american burecracy is much more flexible ... as long as you have a credible case that you were born someday :-)

I am no Guru... but my 2 cents - If you cannot get the birth certificate changed, I think affidavits from your parents with full name would help. I have sample affidavits if you need them. Just PM me.

I had the same issue. But i fixed it. Here they are more concerned with last name. Submit both the affidavit from your parents and also BC or else fix your last name in your BC.Quote:

Last name on Birth Certificate is just a letter. Soggadu Sobhan Babu becomes S.Shoban Babu
Most of you are advising for affidivits... My father is no more and i have my mother and other relatives in india. Can you please let me know the process for getting these affidavits?

Sorry to hear about your father. Regarding birth certificate, your Mother can go to the Municipal Corporation office and request them to check records. They usually ask for few days but with some pleading, etc., they might oblige for a quicker check.Quote:

TB, unfortunately the place where i was born in is very far from where my parents live now and i cant ask my mom to visit there... dont even have any relatives at that place now... Looks like only available option is to have the affidavit... what do you guys think??Quote:

I got "place of birth" mismatch in passport and birth certificate, will this create a problem in my 485 filling, if it's a problem please let me know how this could be resolved.
When I applied my passport i did not have the birth certificate so i had mentioned the place where i stayed since childhood .Now my parents could get back my birth certificate and the place doesn't match with the one given in the Passport .So will it be a problem when I file my I-485 and if it's a problem please let me know how this could be resolved.

As Spec mentioned, I think its a very reasonable question. I can pitch in with some details from my pending I485 (PD 11th July'07). I have incomplete medical records (couldn't finish all the required medical checks before the 16th Aug'07 deadline) and there is a spelling error in my birth certificate. I haven't received any RFE on these yet and I assume USCIS will issue RFEs if/when my PD gets current. However, my case has been active meaning I have finished 3 fingerprints (with the last once being Oct'10), have forwarded AC21 docs to USCIS and have also received a confirmation saying that the AC21 docs have been appended to my I 485 application, etc. I asked my lawyer and she mentioned that USCIS probably has all the required documents in place (they would have issued RFEs on EVL, paystubs, etc if they had concerns) and might issue the medical and Birth certificate RFEs when my case gets current. But, I don't know exactly what's the status of my case, though I will assume that it is not pre-adjudicated since there are missing documents. On a slightly different note, I think USCIS can issue RFEs even on pre-adjudicated cases, right? I mean, even if a case is pre-adjudicated one might need to answer to probable RFEs before getting I485 approval.Quote:

If I have to pick, I'd go with the name on Your passport and marriage certificate. Don't you have any higher educational certificate that you submitted to CIS before, that has both the first & last name?( out of curiosity, you can choose to not answer this question)

At the very least the IBIS check is likely to be out of date. However, USCIS know in advance the dates that will become Current and could perform it in advance, which presumably they did for May / June approvals.
In theory, if it was pre-adjudicated properly, only FP and EVL should apply, since they should have raised RFE for medical, birth certificate etc at the time of pre-adjudication. I do take your point that they may not have been perfectly pre-adjudicated.
My understanding of the CP process is that the visa is allocated to the case by DOS when the interview date is set. If the interview is successful, it is used, otherwise it is returned to DOS by the Consulate. The rate of EB3 returns is typically around 300-400 per month from all sources (data from EB3-C class action lawsuit). Obviously for EB2, which has much lower CP levels the numbers would be correspondingly lower (probably dozens at most).
Therefore, the interview itself does not have to be completed in September, although this could lead to wasted visas, since it is not clear whether, if returned, they can be re-issued once the FY has ended (probably not).
Because of this, I don't perceive the urgency to advance the dates so substantially in the August VB.
I am not entirely convinced they have vast numbers of visas left to allocate. Teddy's figure of around 6-8k seems about right.
CO did say the Demand Data reports would be issued again, although I have my doubts as well.
qblogfan, hang in there. I am seeing a lot of folks getting emotional and sentimental. It makes my voice choke too. Next month I will complete 10 years in the US. I have a bag and a folder full of various documents like birth certificate, school marksheets, all tax returns, pay stubs from day 1, AR-11 printouts, and what have you, everything in the world, my and my wife's entire life story from birth. In my wife's case (she was born in Bangalore), we needed to visit the hospital where she was born and get an affidavit from them that they corrected the name in their records. It was tedious but the procedure was clearly specified and we got it done inside two weeks.
In my case (born in Bombay), they wanted 3 pieces of documentary evidence with my father's correct name from before when I was born. Of course, it was a ridiculous request and I couldn't imagine where I was going to get 3 such documents from 35 years ago, especially since we've all moved out of Bombay. But since my dad worked for the Tatas, who are arguably the most professional and helpful organization in the world I could get this done. Seriously man, my dad stopped working for them in 1979, and they still managed to get me documents from his employment records including a pay stub inside 3 days!
grnwtg, I don't know about reasons, but it's next to impossible to get any change made in birth records, most especially missing blanks. Only way even in India, for any official purpose, like say Passport, you face this problem, you need supplemental evidence, in the form of affidavits and other records. Per lawyer, a school leaving certificate or a letter from school which gives school records (complete name, date of birth, place of birth, date of admission, and names of parents), is perfectly acceptable as secondary evidence to supplement birth certificate problems like yours. Some place even the child's name is not present in birth certificate, just a local dialect equivalent of "baby boy" or "baby girl" is written.Quote:

Affidavit works great. My wife submitted the same. Dont expect any hiccups. I am not aware of any "Required" format. We just made up our own.Quote:
