This is a little more complicated and uncertain.
The answer depends on how the Visa Office handle the situation when EB2 approaches the end of the current backlog up to August 2007.
In one scenario, if the Cut Off Dates for EB2-IC have not been moved forward early enough, there could be a situation where no further EB2 applicants have cases that can be adjudicated immediately. In this case, to avoid wasting Visa numbers, the spare Visas would be made available to EB3-ROW.
On the other hand, if the VO believe spare Visas will be available, the VO could move the Cut Off Dates for EB2-IC forward a few months in advance of running out of cases to adjudicate. If they did this, then new cases would be available to allocate Visas to and there would be no need to allocate any Visas to EB3-ROW.
There is no evidence, either way, as to how the VO will handle the situation. I don't believe it will be an issue for FY2011. If I had to bet, then I think the VO will move the dates for EB2 forward to ensure all the Visas can be used by EB2, unless they specifically want to give some relief to EB3 - that's more a political decision.

thank you for the info it just seems like nothing is easy it never seems to flow it just gets going then it stops the VB in jan knocked me and a lot more backwards still cant work that one out, o'well hopefully not much longer with a bit of luck i can see the light now and i think i am on the home run.
