The same feeling EB-3 India people have when the spillover interpretation changed by USCIS from 2008 onwards, We all should know how to think in others shoes. This is one of the example. When EB-3 people cry about the spillover. most of the EB2 guys will advice them to port. now EB1 people can say the same thing to EB2 asking them to port!!!!... so the thinking should be broader as one EB immigrant community.

It seems for the EB1 Multinational Manager, Qualification is not a criteria, they do not go through the EDGE chamber of Edu Evaluation, they do not required 5 Years of experience after US bachelors or Masters Degree. if this is True, ths is ridiculous and also a big loop Black hole to get people here and process their GC's within 3 to 6 months. This have to be stopped, this is one of the reason for EB backlogs

If you look at all other EB1 categories, they have to meet 3 out of the 10 criteria to prove they are exceptional and there are stricter criteria for other EB categories as well. The only lax one seems to be EB1/C (Multinational Manager or Executive). The original intent was, probably, to bring in Managers of exceptional caliber. Since the criteria are not well defined, and is left to interpretation, companies are finding loopholes.
Legally, there is nothing wrong with these applications as the rule itself is very subjective. Moreover they do not have to file PERM as well. So there is no chance to verify/ prove if another person in US is available to do the same job, wage requirements etc. I doubt, if anything can be done until the criteria for this category are properly defined/ revamped.
And Q this is the sole reason i had mentioned the wrong doings of Qualcomm, Infy, Cognizant. When one has crossed over to the right side of GC, he/she suddenly does not feel the stress anymore, and one feels entitled to act like a mahatma giving sermons of right and wrong. Please note that neither i am not angry of the discussion last week and nor making pun. All this is a pretty human way of reacting to a situation. But when you are in the shoes of someone who cannot take a new job, cannot take a new contract, your PD even though so near, feels like light years away.
@nishant i IMHO, someone would be out of hid mind to invest $500k to $1 million to invest in US via EB5. Past few years of stock market has shown that anything you put over there, just gets taken off pretty soon and you are left with a red colored TD account. That is the sole reason big companies are stock piling their billions and not investing 'cause the whole system has become a one big casino.
I too feel what ssvp22 is saying.It still gets my blood pressure very high and that is the sole reason avoid thinking about the EB1C fraud and other visa frauds.
The experience of the past ten years has taught me nothing will be done by the authorities.Tons of reasons( Anti Immigrant sentiment,economy,Lobbying,Companies which are actively participating in this ponzi scheme )
Anywaz on the topic of the stock market.Just some general advice.
1.The days of buy and hold are long gone.These are the days of HFT ( high frequency trading) .
2.The only ones that benefit from this market are day traders in general and big money.
3.If you are not playing options you will not get to short the market.
4.US recession is 200% sure with the current crisis in Greece.If the greek bullet misses ...next in line will be the PIGS countries.
5.Even if Europe is saved there are sufficient structural problems in the US itself ( Copper down,Railroads down...Unemployment sky high....Fed printing money) .
Anywaz I just hope it contributes something to the SOFAD.
SSVP I have held the same "Mahatma" position on EB1C issue since I started this thread 20 months back.

You shouldn't resort to personal attacks to prove a point. If you really believe EB1C is hurting you, make the point and move on.
Q, i am not making personal attack. All i am saying is that once you are no longer under a situation, it is very hard to understand the stress and situation of other person. This is basic human nature. Its the same for me. For the people who are in this situation right now, it has become like people on ladder pulling the leg of the one on top, and the players are - Recession - INS - and and People without GC.
Also its not about making a point on EB1C and moving on. From my experience and perception, this forum is about forming opinion, analyzing contradicting opinions, and if possible contribute(vote on bills) and take decisions(on personal level till now - like getting medical done....). In the case of EB1C, it is a rampant abuse of law that is happening and people and media need to be aware of that. And from the discussion till now, quite a few people agree to that. And till the time abuse impacts people personally, there cannot be a moving on scenario. If you really want to treat it as your forum, so be it, and i can call it quits on the EB1C issue.
I want to jump in. What you did was a personnel attack just to vent your frustration with EB1C. I do not believe that there is a fraud going on with EB1C but I do believe there is an abuse or misuse of EB1C category. If you are really worried about it, we should do something about it instead of venting out and doing personal attack. I have repeatedly said to all people in the forum who believe in EB1C abuse that I can personally go meet people and highlight it if I we can have writeup highlighting the EB1 loopholes or proof/cases you know. (You yourself mentioned about Infosys asking people for 2 years contract for applying EB1 green cards)
Nobody responded to that . All people want to do is personal attack,whine or vent out their frustration instead of doing something productive.
Also, I don't think it is like that, but if Q has any reservation discussing EB1C problem on this thread, we can galvanise on IV as he pointed to us before about advocacy and let him do the remarkable service he is doing for us in predicting the unpredictable.
To all my Indian and Chinese friends who completed graduate studies in the US:
We have all gone through several hardships to make a life in this country. Several of us came to the US at the time Indian IT industry was growing. Many of us also had job offers in the Indian IT industry which we declined to pursue higher education in the US - we went through a hard life, stayed away from our families, lived just above the poverty line, bought really old cars (many of us did not even buy cars), shared rooms with several roommates and worked harder than a full-time job to get a degree and a training to make ourselves useful in this country. We sacrificed to achieve our dreams.
Today, we are doing respectable jobs - jobs that matter to this country and we are making a difference in our place. And there are thousands like us. We love this country, we love its people and we love its culture and we want to be a part of this society. We have been doing well in our jobs as well, and we are getting promoted to important roles with our employers. Yet we are made to wait in long lines to become permanent residents. We still try to accept all of that as a part of the life in this country.
Then, there are individuals who chose to take jobs in their countries after their Bachelors and earn while we were striving to make a life here. In the time we spent in grad schools learning difficult concepts and making creative contributions to our fields, these individuals did not learn any new skills that would help advance their fields. They got promoted in less competitive environments and became managers with their companies. Now they are transferring to the US on L1 visas and getting GCs by the fast track even while we are waiting in long lines.
At this time, USCIS has raised the bar considerably on EB1A/B categories. Even individuals with PhDs and multiple years of experience in their field of research do not qualify. To attain an EB1A/B visa, one needs to show that he/she "has risen to the top of their field". Yet L1B transferees are able to get EB1C visa with relative ease. Hence, there exists an inconsistency in USCIS policy on EB1 issuance -- with thousands of managers in a large corporations, how can one who has recently become a manager be considered as having "risen to the top"? To add insult to injury, if we get promoted to managerial positions in our companies we still will not qualify for EB1 visa.
Several renowned public policy scholars have been have been talking about it and America is now beginning to realize that outsourcing is only an economic liability and not a boon. Hence, outsourcing companies are increasingly adopting tactics that look less like 'business' and more like 'mafia'. Infosys already is facing lawsuits for felony offenses in at least a couple of US states. It only further underscores the moral bankruptcy of these companies -- they are willing to bend any laws and encroach any boundaries to profit from this country. In addition to lost American jobs, there is also the indirect economic cost of their unethical practices -- lost opportunities for the genuine applicants.
President Obama himself has publicly called for increasing the tax rate on companies that outsource American jobs. Given where things are headed with public policy on outsourcing, it just does not make sense that USCIS grant visas on the fast track to repeat offenders so that they can outsource more jobs and hurt more genuine green card applicants.
Obviously, there is an urgent need for the USCIS to revisit it's EB1C review process. With the entire EB1 quota being used in this financial year, the time to act is now, and it is crucial that we act. The good news is that a logical fix to this system will not require to passage of a law. An internal memo similar to the Kazarian memo for EB1A/B will help USCIS establish the appropriate standards for EB1C.
Here are a few suggestions to start with:
1. Sign the petition started by ImmigrantRbnHd by clicking here: http://www.petition2congress.com/639...dulent-filing/
2. Send an email to Senator Grassley by visiting his contact page: http://www.grassley.senate.gov/contact.cfm . If you can, please take the time to write about your personal struggles while pursuing higher education in the US. This will make him understand the value of the people who are being left behind due to lack of a logical review system.
3. Post on other forums and raise awareness about this matter.
4. Join the google group: http://groups.google.com/group/opposeeb1cabuse . The group was started on 03/21/2012. We will wait for an initial enrollment period (~1 week) before starting active discussions.
5. Reach out to your friends and colleagues and ask them to do the above items. Use Twitter/FB whatever, get this matter the maximum visibility.
