I am on H4 visa and my spouse is on H1 visa. My spouse priority date is 'current' and we both are planning to apply I485 + EAD. I got my H1 approved today and tomorrow we will file I485. All these time I am on H4. My question is, when we file I485 is that mandatory to stay myself on H4 visa status. If that is the case then I have to cancel my approved H1 petition. I recall once, my lawyer said I have to be on H4 status when we file I485. Please help.

Hello Q and other members,
I am currently in Kansas and eligible to file GC in May 2012. Details below:
4 + years of experience
MS completed in 2008
H1B since 2010
Does it make any difference in the time for GC if I start application in Kansas or start another employment in california and start application in california around same time?
In short does it make a difference on the time for GC for applying it in different states?
Thanks a lot Q!

Short answer is NO. But theoretical answer is yes.
PERM has reduced the execution differences between states. In the old days Arizona coud process a labor in 60 days and NY NJ could take 3 years. Now from that angle the difference has gone away. However, theoretically because of the labor availability differences the success or failure rates could be different in different markets and so it might take more time for an individual to have a certified labor. But that is more theoretical difference than reality.
Time to get GC is heavily dependent on Country of Chargeability / Category / Size & Type Employer / Type of Job / US Degree or NOT / Luck ------- in that order! Good luck.

Does anybody know the procedure for taking driving license in Raleigh, North Carolina for H4? do they ask for SSN denial letter? do we need a valid visa in the passport? is it ok if i94 has the petition extension date?
