Teddy,

I think it again depends on the IO reviewing the RFE response. My friend whose RFE response reached on Feb 28 got approval notifications on Mar 08. So, there's still hope for you to get your approvals soon. All the best.

That’s also true, IO does matter, but these RFE volumes have gone up. What’s happening in your case there are cases around my case as well RD 11/02 with no updates. You are a 11/01 case I hope you get a straight approval. Hope T & T (Tackle & Teddy) get approved this week.

Just found an interesting thing the officer for my case & HESANI@TRACKITT is same, we got the RFE on the same day maybe he / she was in a bad mood this day. His response review date is a full week before me, so my guess is its either today if the officer looks into my case or a week if he / she is prioritizing by RFE response review times.

I received my response review on Feb 23 for a flu shot RFI and still no word . NSC . RD Nov 2nd.
Is there anything I can do? Call etc. or just wait patiently?

You can try calling but they won't transfer you to L2 officer until its 60 days from RFE response review date.

Really didn't wanted to come to this thread. But here I am.

Just got an RFE today in the morning, it says nothing about the RFE in the SMS nor in the email. Called USCIS help desk and they said wait for the mail.

Gurus, can you guys let me know whats the process followed on RFE's or someone who has been through it can post about the steps need to be followed on the main post of the thread. It will be of great help.

longwaitforgc, sorry to hear that you got an RFE. The good news is that at least you got some update about your case. You will mostly get the RFE letter within a week or so, hopefully a little faster than that. Until then, not much you can do. Did you file I-485 through a lawyer or by yourself? After you get the letter, let us know what the RFE is about.

AFAIK strictly for RFE response review the timeline is 60 days. But since you are NSC you case is beyond the 4 months. Try calling to see if they transfer you to Level 2 and create an SR, they might just tell you that you are within the RFE response SLA but no harm in trying.

Yes, after RFE response sent back, the clock is kind of reset for 60 days. The 4 month processing time is not applicable in my opinion. If in 60 days you don't get any action, you can inquire.

One trick can be Infopass scheduling, which is more lenient in allowing to schedule appointments, and then based on your luck, the IO at the infopass appointment may or may not help you meaningfully.

That's interesting....I also got to know something similar. Today, I found out that meraNumberAyegaa@trackitt and I have the same officer and he/she just got approved today. His status changed to RFE Response review few business days before mine, so now I know where my adjudicating officer is wrt RFE response reviews, assuming there is some order to the processing, of course.

Got an e-mail from attorney yesterday that he received the RFE for my wife's I-485 from NSC (13 days after e-mail on March 1st). RFE is for a copy of BC , which the attorney said he already has and will mail out soon. Will he be sending the papers for my wife to sign or he can mail them out without her signatures since we filled out G-28 form? On initial I-485 and EAD/AP forms, he did send the papers for our signatures.

Billu, I don't think he needs your wife's signatures on anything this time. He is probably just going to send it out. Mine was the same RFE response filed by the lawyer. He didn't require my signature on anything....

Our attorney just mailed my wife's I-485 RFE response to NSC.With the news of retrogression in the upcoming bulletin, do you think the ones with RFE like us , are in danger too or will we get our GCs regardless of retrogression??

I don't think you will get stuck again. The next visa bulletin, published in April, will be effective only from May 1st. Even if they retrogress in that VB, you still have 1.5 more months to go for review. Going by the trends, you will definitely get approved before then.

thanks. Hopefully her application will be approved soon. I was just curious about how they allot the visa numbers ,especially now that they dont foresee any spilldown and very few visa numbers are supposed to remain for this FY. Is there any monthly allocation, like 9% or so? In that case, wouldnt they have enough visa numbers still left? (54% or more for this FY?)

Hi guys,
As per my post above, my fears have come true. The visa numbers have exhausted and my wife's I-485 case status is "RFE response review" since March 19. Now, do you think we will have to wit till September 2012 for the approval or this talk is just about Q2 visas being exhausted and we have some hope starting next week??

thanks for your response.Yes, it is better than being in initial review but it is very frustrating too because each day, we expect approval as most cases take less than 2 weeks after RFE response review. Specially frustrating as RFE was for an inane reason- for already submitted BCs!!

I am in the same boat as you. One of my colleague got approved after 23 days from RFE Response Review to Approval. RFE cases have been increasing from Jan to March. So, I believe, with each passing day, the duration of RFE processing is also increasing. But, we have time until end of April, otherwise this summer as we are too close to the cut off date.

Yes, mine is NSC. I received the alert emails the same day the status was updated.

buddy looks like we missed the boat. As per the news on murthy, they have internally retrogressed the date to August 15,2007 which means we will have to wait till summer (likely in July or August) before we can receive the visa numbers.

Congratulations on this forum!

I found a few hints and I see that the range of possibilities is endless...

Although a little worried since I thought I did a very precise job in assembling the packege, I got relieved reading some of these forums' answers.

In my opinion it might be the fact that I am filing for different things and tehre was a single set of BC, ETC.

I guess my Legal Assistant didn't catch that part...We'll see

Billu, We are not that far. Any way, I am happy to receive my EAD, which I will put it to good use once I cross this 180 days period.

It's simply semi-retarded that they send you these alerts but they don't tell you what they are for. Then you log in with your case number and there are zero further details????!!!!.....They just drive you insane...It's better just to wait for the mail...old school always rocks! At least you won't lose any sleep while the letter is in transit!

Hello everyone,

I received, finally, after more than a week camping at the mailbox, my RFE in the mail.

It is about the I-864 AFFIDAVIT OF SUPPORT filed by my wife. Apparently, by what we have provided they calculated that she doesn't meet the Federal Poverty Guidelines. Fact is we haven't detailed the case enough and they just looked at the enclosed paystubs without considering her yearly settlement check and her private practice detailed income.

One suggestion I can make. Be as detailed as you can. Do not assume anything. They like to see things in front of them, not trying to make conclusions by imagining what you meant by that... For example in our case we concentrated more on explaining and documenting 2011 income that we did on 2012 assuming they would obviously consider all the documnts and explanations as part of the documentation for 2012 since it will stay the same. Wrong! Do not. Actually I heard that the previous year or three year taxes report can be low or negative and they won't care much. They will mostly focus on current year income, so take the necessary time to satisfy the requirements of I-864P, 2012 HHS Poverty Guidelines for Affidavit of Support available at http://www.uscis.gov/files/form/i-864p.pdf for your specific household size.

We are now reviewing our paperwork and we will send that out ASAP and hopefully this will put us back in business soon!

To all of you receiving RFE Please remember to enclose the original yellow letter when you send all the requested evidence. Obviously you should make a copy for your records.

I got an RFC for my daughter's medical report. The pediatric doctor didn't check some of the boxes..I went and sent the amended form ..

Does it mean that they picked up all three of our cases ( me, wife and daughter) and rest all documents fine except this?

Me and wife status still shows ' Case can't be found' ..

Is it possible that they don't act at all during this idle period and decide to act when my PD is current again, thus wasting few more months in the process and causing us more pain. There is probably no way to know whether my application is completely pre-adjudicated and there are NO RFEs.

Called FBI customer service at 304-625-5590 and got to know that my fingerprint status check was completed and sent back to USCIS on a particular date. Keep your Alien Registration number, SSN (spouse won't have A# yet), name, DOB ready.

Is RFE letter to Attorney only? Why not to the applicants?. What will happen to the applicants who change jobs on AC21 and may or may not have a new attorney?

Is RFE letter to Attorney only? Why not to the applicants?. What will happen to the applicants who change jobs on AC21 and may or may not have a new attorney?

No matter who the attorney is, an applicant also receives a copy of RFE.

Billu, We are not that far. Any way, I am happy to receive my EAD, which I will put it to good use once I cross this 180 days period.

hope you made good use of your EAD. Meanwhile, my wife's 485 is still stuck in RFE response review. looks like it might be one more year of wait as the PDs for EB2 india appear to be starting back from 2006 for FY 2013.

This is the reply for SR in feb 2013 from uscis..

"We have received your service request and researched the status of your case. Our records indicate that your response to our Request for Evidence (RFE) was received on October 04, 2012. Your Form I-485, Application to Register Permanent Residence or to Adjust Status, is currently pending. There are currently no visas available to process your Form I-485. A search of USCIS records indicates your Form I-140, Immigrant Petition for Alien Worker, was approved as 2nd preference. Your priority date is later than the cut-off listed on the visa bulletin for your preference. The February visa bulletin has a cut-off date of 09/01/2004 for 2nd preference - India. Visa numbers are only available for applicants whose priority date is earlier than the cut-off date. Records indicate your priority date is 11/14/2007. As such, your Form I-485 application will not be processed until a visa becomes available......

Does this mean its Pre-adjudicated, is there any use calling them and talking to L2 officer if its pre-adjudicated?

Similar case as mine. I have RFE on 485 Pending. I called them few months ago and also took infopass appointment.
Both officers told me it is preadjudicated.. and waiting for visa.

waiting for L2 officer to call me for last 1 hr, hopefully call can come any minute, I a planning to ask them if its pre-adjudicated

Indiani, call from L2 office might take more than few days. They called me after 3-4 days of me leaving a voicemail. so I would say take it easy and let things fall in place...

waiting desperately might not help us...

1. Can I work on 1099 on my EAD while continue working for my sponsor company on W2? I mean doing multiple jobs on EAD, on W2 for sponsored company and on 1099 for other companies?

2. Can I continue working on H1B and still work on 1099 based on EAD for any other company?

3. If I want to keep working on H1B, do I need to keep renewing my EAD since my wife will be working on her EAD?
