I heard back from the OIA at my univ...they have scanned copies of my I20 when i arrived initially and also the one with my OPT...I am not sure which one to submit for I485 but i have asked her to email me both...


Its been a while since I looked at my I-120s/OPT EADs. This weekend's mission is to find them!!

You still need an H1B for working in academia. One might get off H1B quickly through EB1 in case of well published academic - but the path still goes through H1B - right?

You do if you are "working". But if you are pursuing a PhD you are a student. I'm not sure what status one does a post doc under but I think its F1.

Some universities started issuing SEVIS I-20s little late, So it is possible the initial I-20 is a regular one and the later one is SEVIS I-20. That is the case with our university. This was in 2003 spring(joining) and 2004 Fall (applying OPT). So you might want to check and use the SEVIS I-20 or send both.

For a Post Doc, it will be either J1 or H1 visa; this depends on the policy of the school for international researchers, field of research, country of citizenship, etc. I have seen Post Docs with both J1 and H1 visas; as a thumb rule, most of the Post Docs with Phds from foreign universities start with J1 visas (they might switch to H1, if the duration of Post Doc exceeds 2 - 3 years) and many Post Docs with Phds from US schools have H1 visa (generally, they start on OPT and then move on to H1B visa), but there are surely exceptions to the above.

My attorney also just responded and said it would not be a problem to have the gap between birthdate and issue/seal date. i just checked registration dates on our birth certificates and the difference from birthdate is only 5 days for me and 11 days for my spouse...


You need to pay attention to the registration date first.

If the registration date is few days/few weeks/ few months after birth then you should be fine. Issue date will not make any difference in this case.

If your birth is registered after several years(ex: after 10-25 year) then it is advisable to get affidavits as well.

Hi Q & other gurus,
I have been receiving a part of my pay as per diem. I believe the amount after subtracting the per diem amount is better than what is filed in my LCA (have to check with the lawyer though). Will per-diem pose a problem in the GC process ? Now that I'm so close, all these anxiety triggering questions are popping up.

Your responses are greatly appreciated.

If the LCA & I-140 wages are less than your "Pay less Per Diem", I don't see any issue whatsoever.

If they are not but your total taxable pay on your W2 is more than LCA and I-140, I would still believe that you will be ok.

However if both of the above are false then you may be in trouble. Just a layman's opinion. Check w lawyers/CPAs as required.

My lawyer also asked for it. They ask for it if

{BC Issue Date;Birth registration date} are more than 5-10 years (in some cases even 1 year) apart from the actual Date of Birth.

When it comes to BC the issue date and the registration date matters. If they are close to each other AND are greater than the DOB by 1 year ( conservative), then you need additional docs like HS leaving cert and/or affidavits.

"Any application or petition for an individual currently in F-1 status needs to include evidence the student has been maintaining status and has been authorized employment if applicable. Such evidence usually can be satisfied by submitting the latest Form I-20AB/I-20ID and a copy of the employment authorization card."

Now we are not really most of us in F-1 status right now, but it does indicate the mindset of USCIS is that they want the latest form I-20 and a copy of OPT EAD card to verify maintenance of status in the student visa period. This works for me, because I do not have my firstmost I-20, I did two US degrees, and only have the later I-20, and the later I-20 is in the newer style with SEVIS bar code, as well as I have the old EAD OPT card. This might be good information to know for various folks.

Also a really good thing to note is about the translation:
Please submit certified translations for all foreign language documents. The translator must certify that s/he is competent to translate and that the translation is accurate.

The certification format should include the certifier's name, signature, address, and date of certification. A suggested format is:

Certification by Translator

I [typed name], certify that I am fluent (conversant) in the English and ________ languages, and that the above/attached document is an accurate translation of the document attached entitled ______________________________.

My AOS application is currently being prepared by my lawyer. I'm concerned that if the date retrogress in the next VB then I'll not be able to apply. When is the last date that my application needs to be postmarked so that USCIS can accept it. Ex: if the next VB comes on 10 Oct (& if the dates retrogress) and my application is postmarked Oct 9 then is it ok.

To all who are expecting your dates to be current, collect all your reqd AOS documents, get medicals (I-693) done & push you lawyers to have the I-485, G-325, advance parole etc draft ready so they can apply early.

If you are current in October,2011 bulletin and date retrogresses in Nov,2011 bulletin, You are still good as long as the application reaches the uscis center before November 01,2011.

you are current atleast until end of October. The Nov Visa Bulletin (released in Oct) will be effect 1st Nov 2011.

Only exception to this is that if DOS releases a special bulletin/mentions in Nov bulletin that they will not be accepting the October current applications after a particular date in October - CHANCES of this in my opinion is remote and negligible.

Note: During July 2007 fiasco... DOS gave a date (17th Aug 2007) by which all applications should have reached USCIS. As far as I know this is the only time that such a date was provided in recent past.

Most likely it will be Oct 7th the friday. VB might come same day or on Oct 10th monday. Or both may come on oct 10th. I don't think, in my opinion, the demand data is going to have any bearing on Nov VB.

If your pay after subtracting the per-diem is higher or equal to whats mentioned in LCA you should be good. Per-diem is for daily expenses like travel, food or phones based on business need. If the pay is falling below LCA after subtracting then better to check with your Lawyer on how to equate and show that you are earning as much as listed for that opening. And get clarification if Per-diem can be included to meet that amount.

Current PERM processing times.

as per http://icert.doleta.gov/ it shows that Analyst Review which I think is the most common case, as May 2011. So does this mean there is a 3-4 month time period right now for PERM processing.

They also mention there: " If your application was filed more than 3 months prior to the month posted, you may contact our Helpdesk for a status on the application"

My priority date became current based on the October Visa Bulletin, but my attorney says that because DOS ran out of visa numbers in September, we can't apply for GC until we hear anything further from them regarding new cut-off dates for October. Has anyone faced similar situation (i.e. priority date is current, but visa numbers unavailable)?

Another thing is ... unlike labor and 140 ---- 485 is YOUR application. Employer owns labor and 140. But YOU own 485. So when the date is current just go ahead and file 485. If this lawyer can't do it for you .. find another or do it yourself.

soggadu I do not know specifics. But it should be straightforward since 485 by definition is owned by beneficiary. So the forms available on USCIS site should explain all supporting documents.

p,s, - another tidbit - In 485 stage your lawyer has to each time take your permission to represent you in front of USCIS - be it EAD or AP or any inquiry about 485 etc.

Good going. I think the 2012 numbers and model is quite good. People will find tremendous value out of that.

The multi year model - you did good by putting health warning ;) I agree that its very difficult to predict even one year... so multi year is something that should be used only as a general direction.

Use used FY12 and FY13 (with and with out porting), can i know did you mean begin of FY or end of FY or you mean to say some time in FY. I dont want you to be specific, but out of curiosity as when we say FY (its an year). Hope you see where am coming from.

There is a posting by OH Law Firm, on their breaking news area under title: 09/28/2011: USCIS Adjudication of Employment-Based Immigration Cases (I-140 + I-485) as Reflected in its July 2011 Trend and Volume of Processing Statistics

They are analyzing that USCIS has huge backlog (we already know), but also note that they are not pre-adjudicated 485s also alongwith they way they used to, and are falling behind on it, or not making much progress on it. example: a guy in EB2 ROW applies, he gives in 140 and 485 concurrent filing. While 140 is being processed, the 485 is already begun pre-adjudication process, and by the time 140 is approved, the 485 is already pre-adjudicated waiting for a visa number and 140 approval. But if this is not done, then after the 140 process, the 485 process majority chunk will take time, and lead to less SYA (same year approval).

I think all in all, if the above is true, it might be good for SOFAD. Also it kind of shows the need to take in fresh intake to have a big inventory of EB2 I/C early on, they really don't want situation of having to process huge amount of 485 in 3 months. How do you guys read it, let know.

Employment contracts are a state subject and are mostly governed by state law. They are fully enforceable in states like NY & NJ that is why most consulting companies like to have their offices here. In states like CA they are not even worth the paper they are written on.

Teddy, thanks. Really good info. Delware if I am not wrong is most business friendly. In such a small places there are far too many companies located.

Since we have reached the beginning of the new year, I will be curious to know if we have any new insights on how USCIS might approve I485's for the coming year. One possibility is the dates will move forward in the next couple of bulletins to fill up the buffer and then retrogress in Jan'12. The forward movement of the PDs will be again visible during the spillover season from April-May'12 onwards. I think for most of the PWMBs, it is unlikely that their I485 approval will happen in 2011 as the turnaround time for I485 approval is 3 - 4 months.

We still have 8K pending EB2-I/C cases (~6K up to July 15th) and anywhere between 1K - 2K cases with PD up to April'15 that hasn't been approved yet. In addition, there will be some EB3->EB2 porting cases. Adding all these, there are already around 10K+ cases that are pre-adjudicated and waiting for approval. My question is whether these cases (or at least a decent number of these cases) will be approved in the Fall quarter itself or during the spillover season. My hunch is most of these cases will be approved during the spillover season (April-May'12); else, USCIS needs to allocated twice the stipulated quota of 5.6K for EB2-I/C in the Fall quarter itself.

Look forward to any feedback on this!

Alright friends. Now is the time to close this thread and open 2012 thread.

First of all, I must say (and this is not just a figure of speech) that tons of people have contributed to this thread and to this forum. Yes sure some people more than others. But every single post counts and I do believe that by and large people absolutely posted with good intentions and their posts were helpful to at least some people. So thank you for that.

I feel good about the predictions we made and this was a very satisfying year in terms of our accuracy. What I feel even more better about is the fact that so many - so many - people now understand the lingo we use and have interest in understanding how this GC process works. I think that takes us closer to our goal of helping people make better decisions about their careers and lives by providing them clarity.

Today we reached 1M views on this thread. In all this forum had 1.1M views since Oct 10th last year. Although we had achieved much bigger success on IV, I was not sure how this thread will be received on its own website with one of the weirdest names "QESEHMK"!! 1M has a nice ring to it and I like this number :) I don't want to lie - this has certainly stoked my ego. But I think that is where I should leave it!! Teddy and I do talk quite frequently and I have always maintained that he should continue to do what he does on IV because it helps people and that makes this work worthwhile.

So a very special thanks to Teddy. Teddy is a wonderful resource and a wonderful human being (those of you who know him personally). Equally special thanks to Spec who is a walking encyclopedia of all things immigration law and has outstanding insight. But what I like most about him is the fact that he probably isn't even Indian or even Chinese and cares about EB-IC. I think we should respect his privacy and enjoy his analysis. I also must thank Veni and Nishant for their very very significant contributions to the thread and the patience to answer so many questions that people tend to ask them. Thanks to qblogfan for being our eyes and ears with our chinese friends. Soggadu thanks to your for keeping the forum light. Once in a while we get tense but Soggadu's humor keeps us going. There are so many others ... its not possible to name everybody. But I want you to understand that every single post counts and is appreciated. Even if it present contrarian thoughts. In fact we encourage it.

Lets keep the ball rolling. Spread what we know to others for their benefit. And hope 2012 turns out yet another good year for this community. My best wishes and heartful thanks for your participation.
