JoinedToAsk - EAD/AP and 485 application is processed separately. I see people are getting EAD after their PD become current and also getting 485 approval after few days of EAD approval. So there is NO standard processing pattern all is random basis. If you are lucky you should expect your green card within 1-3 months of your 485 application is actively touched (485J notice or issuing RFE).

You should, as soon as possible. Don't overthink. Field office's adjudication is faster than service center's.

On Friday night online status was updated to "Initial RFE sent". Looks like for the folks whose I-140 is approved, Bio is done and PD is current received the RFE.

I asked them to hold onto medicals until RFE arrives to see what it is and to get the correct addresses assuming it's for I-693.

Right now the approvals are all over and random. There are folks from 2009, 2010 who files in 2012 still waiting.
Also a lot of people from 2010 PDs filed first time in Oct/20 also are waiting and have seems some approvals with PDs from May to Dec 2010 and also some in 2011 for all straight forward cases.
So everything is luck of the application being picked up.

sstest - I am in a similar situation, my case status has been updated showing RFIE sent but nothing for my spouse and son. I am hoping that an actual letter will come for all of us. I sent an email to the attorney for advice, will keep you posted. Please let me know what you hear from your attorney.

There is no need for a cover letter. You just need the sealed medicals and a copy of the RFE letter. If you plan to send it in a single mail, the advice I saw from many was to put each applicant's sealed medicals & copy of RFE letter into individual envelopes and then put these envelopes into the mail envelope and send it out. In my case, I sent them out in separate mail envelopes as me and my wife got separate RFE letters. The choice is yours.

It did not get to interfiling discussion with lawyers as my spouse's status got updated as part of 08/03 RFE bulk update. The physical letter got delivered today.

I will touch base with attorneys on Monday to see when can they ship the responses.


I was curious though about the prevailing thoughts on what comes next after RFE responses for these bulk updates given that these RFE letters, at least for us, came from NSC. Will the application move to FO after this or is this year special where they will issues GCs directly from NSC.(My lawyer was saying that she has never seen applications in similar downgrade cases getting adjudicated without going to field office)

In trackit I am reading and also in my company, lot of folks having the same issue. They received the dependent's RFE letter but not primary's. Maybe it's on the way. Yes, I can request an e-copy on or after 8/14; I think that's a better option than interfiling.

For my dependents' RFE letter, it says "send the response back in the enclosed envelope" but there is no envelope enclosed. From your update what I infer is, I can safely send to the address mentioned on the top right corner.

Three months seem to be a long time. Are you happy waiting or you want to give your case a nudge?
You can try calling or congressman or online SR (if that lets you). Any route you take, play dumb and tell them that your sent RFE response and tried to contact USCIS multiple times but you are not getting any response. Don't know what's wrong. Good luck.

My company also showed a loss on the 485J but I did not have any issues since I have been with the same firm for more than 13 yrs now. Did you file I-485J after you switched or just filed H1 transfer? It could be just a normal RFE to get an updated SuppJ, but make sure your employer and accounting is completely clued in on this and provide any additional documentation that is requested without delay.

And the primary application online status updated with 'correspondence received ' in exactly one week.it seems interfile of medicals has worked.

Confirm that the job offered to you in Form I-140, Petition for noncitizen Worker, remains a bona fide job offer that you intend to accept OR
Request job portability under INA section 204(j) to a new, full-time, permanent job offer that you intend to accept

Normally they should not have sent an RFE as you are working for the same company. But in your case, the AO just wanted you to provide proof instead of he/she looking at details of your file. An RFE is a good progress for any GC application. Good Luck.

I submitted a SR, but came to know my case moved from NBC to FO and now back to NBC. But my dependent's case is NBC ->FO, as the SR for them has FO code in it.
Is this normal ? Does this signify anything ?

I see i485 notices in my USPS mail preview today. As much as I can read through the images, they seem like interview notices. In my cases, looks like they have put a document asking for citation details (probably my traffic tickets). Will know in a few hours.

The hope is that the interview happens in September else it seems like I will have to get the medicals done again. Also, will have to do some running to get details on my citations. Wish my interview was waived :(

I do not have first hand info on this.

By any chance, do you think the question "had been arrested, charged, cited (excluding minor traffic violations)." was answered as yes on your I-485. If yes then they may be asking about it.

Best to go through your lawyers for this RFE. Regarding your question, DMV can provide records of traffic violations.

Did you fill out the I-485 yourself or did the legal team do it? Instructions to I-485 does say that any traffic violations below $500 (and no arrests) do not require any documentation (and can be interpreted that the answer to Question 25 on I-485 should be no if that is the case -- though I understand there is a debate whether it should be yes or no). Clearly you answered yes to the question - so I guess the rfe reponse should be showing that the fines were below $500 and minor (no arrests) -- typically that would be a copy of the traffic tickets (assuming you paid the tickets and didn't go to court).

I would definitely recommend taking advice from the lawyer. If you don't have any details of the tickets, the only other thing I can think of is to to go to your state's DMV website and pay to get the driving record. The driving record should have all the infractions noted on it.

Gurus - I need some help. My online status changed on Sept/01 to RFIE and we waited for the mail to arrive. But no mail arrived till date. Today I went to Emma chatted with live agent who opened a L2 officer call back. The L2 office called me now but he too could not see the RFIE details as it was not attached to the case. The L2 told me to open up the ?mail document not received? on USCIS website ( I did it, resolution time is oct / 08).

Anyone in same boat or experience? What are my options? Any advise is highly appreciated.
